f <br />BOARD OF ZONING APPEALS OCTOBER 1, 1980 PAGE 3 <br />? Joseph Bauer, Permanent Parcel 235-18-14, Located on south side of <br />Bellevue Dr., east of 27137 Bellevue. <br />Request for variance (1133.13). Request 35' front set back var- <br />iance. Violation of Ord. 62-33, Section 1163.01. <br />Chairman Ledvina called all interested parties before the Board. <br />The oath was administered. L. Rego, attorney, representing the <br />developer explained that the lot is only 70' deep and 161' wide <br />and the proposed home would have a 15` front set back. The Law <br />Director explained that the lot was purchased in 1971 or 1972 and <br />was conveyed by deed and not submitted for subdivision; it would <br />not be practical at this time to submit it. Presumably the sub- <br />division would have been accepted since there were no Ordinances <br />governing the depth of a lot. The adjacent property owner stated <br />that she had refused to sell the adjoining property to Mr. Bauer <br />on several occassions and she still has no intention of selling. <br />! The other home in the development have conforming set backs, and <br />this house will'be beside the front yard of the house next door. <br />Neighbors felt that it would be a safety hazzard with cars parking <br />over the sidewalk and int the street since the driveway would be <br />only 15'. E. DeVoto moved to deny the variance,. seconded by C. <br />Remmel, and unanimously approved. Request denied. <br />? <br />The meeting was adjourned at 8:40 p.m. <br />. ? <br />D.
