CITY OF NORTH OLMSTEll <br />BOARD OF ZONING APPEALS <br />"- MINUTES - JULY 2, 1980 <br />Chairman Ledvi.na called the meeting to order at 7:30 p.m. <br />Present: D. Ledvina, C. Remmel, E. DeVoto, L. Horvath, and W. Wasniak <br />Also Present: Building Commissioner E. Gundy, Law Director M. Gareau, <br />and Recording Secretary B. Oring. <br />Mr. Remmel stated that in the Minutes of June 11, 1980, cases number <br />5 and 6 the statement that "L. Horvath, a member on the Board, is <br />neither related to or connected with the appellant, Horvath Builders", <br />should be included. L. Horvath moved to approve the Minutes of June <br />11, 1980, as ammended, seconded by C. Remmel, and unanimously approved. <br />1. West Haven Foundation for the Retarded. Chairman Ledvina advised <br />that this case would be heard at the end of the meeting. <br />2. Kenneth F. Barberic, 3493 Columbia Rd. <br />Request for variance (1133.13). Request for 6" height variance for <br />fence in front set back. Violation of Ord. 62-33, Section 1151.04. <br />Ch airman Ledvina called all interested parties before the Board. The <br />oath was administered. Mr. Barberic advised the Board that the fence <br />was installed by a fence company without a permit and that he was un- <br />aware that it was too high and that no permit had been obtai.ned. E. <br />DeVoto moved to app rove the variance, seconded by L. Horvath, and unan- <br />imously app roved. . \ <br />3. William Clifford, 24734 Doe Dr. <br />Request for variance (1133.13). Request 5' variance for distance <br />between house and garage. Violation of Ord. 62-33, Section 1151.04. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administeredo The Agen da was amended to in clude a 3' rear <br />yard variance. (Violation of Ord. 62-33, Section 1163.01). L. Horvath <br />moved to approve both variances, seconded by C. Remmel, and unani- <br />mously approved. <br />4. James C. Walters, 29750 Broxbourne <br />Request for variance (1133.13). Request variance to keep 2 boats on <br />one lot. Violation of Ord. 62-33, Section 1151.04 Para. K. <br />Chairman Ledvi.na called all interested parties before the Board. The <br />oath was administered. During the discussion it was determined that <br />these boats were actually s tored on a vacant lot owned by 24r. Walters so <br />the variance should reado Violation of Ordo 62-33, Section 1151.04 (K). <br />Mr. Walters advised the -Board that he owned 2 houses and 2 vacant lots <br />on Elmhurst and he could store one boat at each house. However, he <br />felt that it would look better to have both boats stored on one location <br />temporarily while he is working on them and refinishing his barn. M.
