BOARD OF ZONING APPEALS JUNE 11, 1980 - PAGE 2 <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. Chairman Ledvina stated that both,:this case <br />and number 6 would be heard together but voted on separately. A state- <br />ment was read from Horvath Builders stating that a variance had been <br />granted on March 29 1977 for a 5` rear yard variance (this variance <br />has now expired). This variance is required in order to develop the <br />lots within the "A" residential area requirements. These houses will <br />be commensurate in value with the other homes in the subdivision. <br />The neighbors to the rear do not find the variance acceptable. It <br />was explained that this variance is necessary inorder to build a house <br />wide enough and still meet area requirements. One resident of Newton <br />Circle feels that in order to biu.ld a house comparable to his that <br />this variance is necessary. C. Remmel moved to grant the v.ariance on <br />S/L 9 Newton Circle, seconded by W. Wasniak, and unanimously approved. <br />Variance granted. <br />6. Horvath Builders, Inc. (Emil Horvath), S. 5 Newton Circle. <br />? Request for variance (1133.13). Request 8.5' rear yard variance. <br />??y Violation of Ord. 62-33, Section 1163.01. <br />(Heard with case Number 5). W. Wasniak moved to grant the variance <br />on S/L 5 Newton Circle, seconded by L. Horvath, and unanimously <br />approved. Variance granted. 7. Bernard McKenna9 S/L 12 Elmhurst (Property between 5822 Elmhurst and <br />5802 Elmhurst. <br />Request for variance (1133.13). Request 2' total side yard variance. <br />Also, request 6" variance distance between dwellings. Violation of <br />Ord. 62-33, Section 1161.01. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was admi.nistered, C. Remmel moved to grant both vari.ances, <br />seconded by L. Horvath, and uanimously approved. Variances granted. <br />8. Sebastian.,D: Codespoti, 5004 Hampton Dr. <br />Request 'for variance (1133.13). Request 92 sq. ft. variance for shed, <br />also 3' 1" hei;htvariance. Violation of Ord. 62-33, Section 1151.04 <br />Para. (D). <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. The agenda was amended to read a 4' 11" height <br />variance. On June 13, 1979 a 92 sq. ft. variance was granted, but the <br />height variance was denied. The property to the rear is Metropolitan <br />Park and the surrounding neighbors have signed statements that they <br />are not objecting to the variance. Mr. Codespoti request an adjourn- <br />ment until there is a full Board present. Chairman Ledvina denied the <br />request. W. Wasniak moved to grant the 92 sq. ft. variance, seconded <br />by C. Remmel, and unanimously approvede C. Remmel moved to approve <br />the height variance, seconded by L. Horvath. Roll call on motion: <br />Wasniak, Yea; Messrs. Remmel, Horvath, and Ledvina, Nay. Height <br />variance denied. Note: This was a vote of 3 to 1 so the presence of <br />the 5th member would not have made a difference.
