J l <br />CITY OF,NORTH OLMSTED • <br />BOARD OF ZONING APPEALS <br />NOVEi9BER 14, 1979 - MINUTES <br />Chairman Ledvina called the meeting or order at 7:30 p.n.. <br />Present: D. Ledvina, C. Remmel, and L. Horvath <br />Absent: E. DeVoto <br />Also Present: Building Commissioner.E. Gundy and Recording Secretary <br />B. Oring <br />C. Remmel moved to approve the minutes of October 10, 1979. as presented9 <br />seconded by L. Horvath, and unanimously approved. <br />1. Aivars Auzenbergs, 27973 Blossom Blvd. <br />Request for variance (1133.13). Request 2' variance for portion of <br />fence. Fence already erected. Violation of Ord. 62-33, Section 1151.04. <br />Chairman Ledvi.na called all interested parties before the Board. The <br />oath was administered. Mr. Auzenbergs explained that they wanted the <br />higher fence in the area of the patio, and if he moved the fence in <br />five feet from the property line so that it could be considered a <br />privacy screen he would have to eliminate a large maple tree. Mr. - <br />Remmel observed that the six foot portion of the fence is 32' and <br />extends quite a distance beyond the patio. A neighbor stated that he <br />was concerned about the fence lowering his property value. C. Remmel <br />moved to grant the variance, seconded by L. Horvath. Roll call on <br />motion: Messrs. Remmel, Horvath and Ledvina, nay. Motion failed to <br />pass. Request denied. <br />2. William Reilley, 24322 Fairlawn Dre <br />Request for variance (1133.13). Request 1'2" sideyard variance for <br />fireplace. Violation of Ord. 62-33, Section 1161.01. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. The request was explained. L. iiorvath moved to <br />grant the variance, seconded by C. Remmel, and tmanimously approved. <br />Request granted. <br />3. Kevin P. Much&, 23918 Frank St. <br />Request for variance (1133.13). Request special permit to add to non- <br />conforming dwelling. Special permission required Ord. 62-33, Section <br />1161.91. <br />Chairman Ledvina called all interested parties before the Board. The i <br />oath was administered. It was explained that Mr. Muche needs a special <br />permit because the front set back is only 40'. C. Retmmel moved to grant <br />the special permit, seconded by L. Horvath, and unanimously approved. ' <br />Special permit granted. ?
