Violation of Ord. <br />62-33, Section 1151.04. Also request permission to add to non-conforming <br />dwelling. Special permit required Ord. 62-33, Section 1161.01. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. Building Commissioner Gtmdy explained that there <br />was no need for a special permit in this case, the radio antenna is not <br />proposed as an addition to the house. It was explained that the radio <br />tower and antenna were 49.5 feet high and conforms to the height Ordi- <br />nance. Mr. Mate i,s asking to construct the tower 3 feet from the house <br />at the rear, not at the gabled side. It was agreed that the tower would <br />be less conspicuous in that location. D. Ledvina moved to grant the <br />variance, seconded by L. Horvath and tmanimously approved. Request <br />granted. Mr. Remnel stated for the record that he is opposed to all <br />50' radio towers as approved by ordinance, and feels that the ordinance <br />should be changed. <br />5. Herman Lackinger, 23559 Carriage Lane. <br />Request for variance (1133.13). Request 1'8" variance for distance <br />betcaeen adjacent dwellingso Violation of Ord. 62-33, Section 1161.01. <br />Chairman Ledvina called all interested parties before the Board. The <br />oath was administered. It was explained that this variance is only for <br />the distance between the fireplace and the adjacent dwelling. C. Remmel <br />moved to grant the variance with the condition - that -the chimney be at <br />least 3' higher than the -existing chimney on Mr. Lackingert.s house, <br />seconded by L. Horvath, . and Lmanimously approvede Request .granted. <br />6. North'Olmsted Board of Education, North Olmsted High School 5755 Burns Rd. <br />Request for variance (1133.13). Request for 2' -variance for fence <br />(3' 6" variance in front set back area). Violation of Ord. 62-33, Section <br />1151. 04. <br />Chairman Ledvi.na called all interested parties before the Board. The <br />oath was administered. Many neighbors were present. Mr. Hussey and <br />other neighbors -spoke-. in favor oi a-.6'- fence since there-has -been' much <br />proparty '.damage by the s tucients . Iiawever, there is some concern that <br />some trees on the property line will be removed in order to construct <br />the fence. The neighbors were advised that if the trees extend onto <br />their property, the School Board cannot legally remove them. Mr. <br />ledvina pointed out that in the front set back area, the legal fence <br />height is 30" and there could be no high plantings along the fence to <br />obstruct the view from the driveways.. L. Horvath moved to grant the <br />request with the condition that if any portion of the trees are on the <br />property line the trees will remain and in no way will any planting in <br />the front set back area be high than 30", seconded by D.
