? < 8 CITY OF NORTH OLMSTED BOARD OF ZONING APPEALS JUNE 13, 19 79 - MINUTES Chairman Ledvina called the meeting to order at 7:30 p.m. Present: Chairman Ledvina, J. Fairfield, L. Horvath and E. DeVoto. C. Remmel arrive d at 7:40 p.m. Also Present: Law Director M. Gareau, Cotmcilman R. Wilamo§.ky, and Recording Secretary B. Oring. Review and Correction of Minutes: Minutes of May 2, 1979 correct last sentence of page 2 to read "C. Remmel moved that the request be granted, with the condition that this use as the real estate office only is approved while Mr. Searl uses these premises as his residence4; seconded by J. Fairfield, and unanimously approvedo" Also, Case #9, Iuation should read: "C. Remmel moved to grant the Variance for a 5' chain link fence along the rear property line, seconded by Mr. Fairfield, and unanimously approved. J. Fairfield moved to approve the Minutes of May 2, 1979 as corrected, seconded by L. Horvath, and unanimously approved. Cases continued from May 2, 1979: Gerald A. Danzey, 4456 Lansing Dra Request for variance (1133.13). Request for 17' variance (reduced from 19' 8"), violation of Ord. 62-33, section 1159.01 and request for variance (1133.13). Request for 1' side yard variance violation of Ord. 62-33, section 1161.01 to build attacYied garage. Chairman Ledvina called all interested parties before the Board. The oatli was administered. The case was reviewed. Mr. Horvath moved to grant the variance, seconded by Mr. Fairfield. Roll call on motion: Messrs. Horvath, Fairfield, and DeVoto, aye, Chairman Ledvina, Aay. Request granted. Anthony J. Lavatti, Jre P.P. 234-22-17 vacant lot at 6288 Stearns Rd. Request for variance (1133.13). To retain the non-conforming building (garage). See condemnation order dated 2/8/79m Violation of Ord, 62-33, Section 1151.04, Accessory uses. . Chairman Ledvina requested tliat all interested persons appear before tYie Board. The oath was administered. Mr. Lavatti advised the Board that the prospective buyer was no longer interested in buying the property, but that he was still requesting a variance to allow the garage to remain on the property without a main building while he was in the process of selling the property. Mr. Remmel moved to deny the variance, seconded by Mr. DeVoto, and unanimously approved. Request deniedo 1. David M. Simna, 4406 Birch Circle. Request for variance (1133.13). Request 3' variance for fence. Violation of Ord. 62-33, Section 1151.040 Chairman Ledvi.na called all interested parties before the Board. The oath was administered.
