Mro Remmel observed that an office building is being <br />planned in that area and that a buffer strip was mandatory in order to get <br />the necessary variance, and he feels that this request is premature, since <br />this buffer strip will probably...alleViate Mr. Simna's problem. Mr. Fairfield <br />moved to deny the variance, seconded by Mro Reumnel, and unanimously approved. <br />Request denied. <br />2. John Izzo, 4105 Brendan Lane - Request for variance (1133.13) for tool shed <br />already constructed. Request lt 6" side yard variance. Violation of Ord. <br />75-117. Request for variance, request 3' height variance for tool shed. <br />Violation of Ord. 75-117. <br />Chairman Ledvina called all interested parties before the Board. The oath <br />was administered. Mr. Izzo explained that because of tree roots he could <br />not moved the shed so that it would be located 5' off the side property line. <br />Mr. Remmel moved that the Board grant the 1' 6" side yard variance, seconded <br />by Mr. Fairfield, and unanimously approved. Mr. Remmel moved to deny the 3' <br />height variance, seconded by Mr. Fairfield. Roll call on motion: Messrs. <br />Remmel, Fairfield, Horvath, Ledvina, aye9 Mr. DeVoto, nay. Side yard <br />variance granted. Height variance denied. <br />3. Stephen 6dagner, 24138 Elm Rd. Request for variance (1133.13). Request <br />special permit to add to non-conforming dwelling. Special permission required <br />by Ord. 62-33, Section 12-31.02. Request 10" side yard vari.ance. Violation <br />of Ord. 62-33, Section 2259.01. Also, request for variance (1133.13). Request <br />6T ;:7" tonal :sideyard variance, violation of Ord. 62-33, section 1231.02. <br />Chairman Ledvina requested all interested parties to step before the Board. <br />The oath was admi.nistered. Mr. Ledvina noted that a 3rd variance was also <br />required, a 1' variance for the distance between dwellingsa It was explained <br />that the patio w.as adjacent to the, neighbors kitchen, and not the bedrooms, that <br />this patio cover would eliminate an ice build-up at the side door, and that <br />there was no rear door so it would be impossible to put it to the rear of the <br />house. Mr. DeVoto moved to grant the variance, seconded by Mr. Horvath. Roll <br />call on motion: Messrs. DeVoto, Horvath, and Ledvina, Yea, Messrso Fairfield. <br />and Remmel, nay. Request granted. <br />4. Frank Finlin, 3387 Hunter Dr. Request for variance (1133.13). Request 2 ft. <br />variance for fence. Violation of Ord. 62-33, section 1151.04. <br />Chairman Ledvina called all interested parties before the Board. The oath <br />was administered. Mr. Finlin's attorney presented the case. The neighbors <br />have a swimming pool which was put in prior to the ordinance requiring a <br />6' fence, and to screen their family room from a spotlight which shines into <br />tlieir window they feel the 6' fence is necessary. The neighbors objected to <br />the construction of the fence. Mr. Fairfield moved to reject the variance, <br />seconded by Mr. Remmel, and unanimously approved. Request denied. <br />'S. Carl D.
