I+ M <br />?. <br />. BOARD OF ZONING APPEALS MAY 2, 1979 PAGE 2 <br />Chairman Ledvina called all interested parties to step before the Board. <br />The oath was administered. Mrs. Baker explained that she had bought a <br />? large sheppard dog for protection and that a4:ft.fence would not contain <br />it. After a discussion, Mrs. Baker changed her request to a 5' fence. <br />Mr. Remmel made a motion to reject the request for a 5° fence, secon ded <br />by Mr. Fairfield, and unanimously approved. Motion passed, request denied. <br />3m Dr. R. M. Kubinski, 24707 Lorain Rd. Request for special permit to add <br />to a non-conforming building. Violation of Ord. 62-33, Section 1231.02 (B-2) <br />Chairman Ledvina asked all interested parties to step before the Board. <br />R. Suesse, Dr. Kubinski's contractor, was representing him. The oath was <br />administered. 'This is a request only for an alteration and moderni- <br />zation of an' existing non-conforming building. Mr. - Horvath moved to <br />approve the special permit, seconded by Mr. Fairfield, and unanimously <br />approved. C. Ledvina advised Mr. Suesse that since this is a commercial <br />special permit the request would have to be approved by council or if <br />coLmcil takes no action, within 30 days the decision of the Board standso <br />Special permit granted. <br />4. William'Medlen, 4842 Grace Ave. Request for variance (1133.13). Request <br />for 6' stockade fence for swimming pool on a corner lot. Violation of <br />Ord. 62-33, section 1151.04 Para (H-2) (ammended Ord. 77-128). It also <br />appears according to the records of the Building Dept. that this fence <br />will encroach into the State of Ohio perpetual easement as indicated in <br />Map 237, Plat 16. <br />Ch airman Ledvina asked all interested p arties to step before the Board. <br />The oath was administered. A letter was sent by the State of Ohio,' <br />Department of Transportation.stating that they object to the erection <br />of a fence on any portion of the State's perpetual limited access <br />easement. It was explained to Mr. Medlen that he could not install the <br />fence in the State of Ohio easement and that he would still need a <br />variance to put up a 6' fence along his property line because he was on <br />a corner lot. After some discussion, Mr. Fairfield moved to approve <br />the variance for a 6' stockade fence as shown on the print, no portion <br />of which could be on the State of Ohio easement, with the understanding <br />that the fence stops at the end of the garage, seconded by Mr. Remmel, <br />and unanimously approved. Request approved. <br />5o Norman Serle, 5359 Decker Rd. Request for variance (1133.13). Request <br />for change of occupancy (from Tailor Shop to Real Estate Office). <br />Violation of Ord, 62-33, section 1151.04, Para. A. <br />- Ch airman Ledvina asked all interested parties to step before the Board. <br />. The oath was administered. It was explained that this property was in <br />a residential area but had been used as coinnercial property prior to the <br />VnYlV Ordinance, and permission is necessary to change use of the property <br />?Fti „, <br />each time the ownership changes. Building Commissioner Gimdy advised <br />? Mr. Searl that no sign rights had been established and that he is <br />' Ib <br />? restricted to a 2 foot square sign which is allawed in a residential <br />area. C. Remmi-l moved that the request be granted, with the condition
