<br />BOARD OF ZONING APPEALS MARCH 7, 1979 PAGE 2 <br />explained that this was a playhouse. Mro Gundy explained that <br />this playhouse is not considered tmder the ordinance limiting <br />the square footage of an accessory building. Mr. Horvath moved <br />to grant the 15° variance for a tool shed, seconded by Mr. Fairfield, <br />and imanimously approved. Request granted. At this point Mr. <br />Dvorak asked if he could switch the two buildings and put the <br />playhouse where the tool shed was to be, Mr. Ledvina advised him <br />that he could not. <br />3. Edward Mercier and Dale Hotchkiss, Permanent Parcel Numbers 233-19-18 <br />and 233-19-19e Request for variance (1133.13). Request to re- <br />subdivide one 100' lot into tao 501 lots. "C" District requires <br />60' minimum frontage. Violation of Ord. 62.33 Section 1157.01. <br />Chairman Ledvina requested that all interested persons appear before <br />the Boarde The oath was administered. The property in question had <br />originally been two 50' lots, but had been assembled into one by <br />the previous owner. It was sold to Messrs. Mercier and Hotchkiss <br />as one lot which could be divided into two. This is in a class "C" <br />area which requires 60° frontage to build, Mr. Remmel pointed out <br />that the lots on that sectiori of Whitehaven and the adjacent <br />Broxbourne Road are all at least 60" lots and larger. Mr. Remmel <br />moved to reject the request, seconded by Mr. Fairfield and unanimously <br />approved. Chairman Ledvina advised that Mr. Mercier and Mr. <br />Hotchkiss should get legal counsel since the lot was misrepresented <br />by the seller. Variance denied. <br />4. Norman Palider, 30175 Lorain Rd. Request for variance (1133.13). <br />Request for special permit to add to non-conforming building. <br />Request for variance (1133.13). The building now exists as a- <br />legal non-conforming building by virtue of a 36' separation to the <br />rear yard which is zoned single residential. This request for- <br />variance is to encroach 18° further into rear .yard separation and <br />the variance request is for an 18T rear yard instead of the requi.red <br />50°. Violation of Ord. 62-33 Section 174.06. <br />Chairman Ledvina requested that all interested persons appear before <br />the board. The oath was administered. Mr. Palider wants to add to <br />the rear of a presently non-conforming, commercial garage. The <br />property backs up to school property which is considered residential <br />and requires 'a 50' rear yard set back. Mr. Remmel moved to grant <br />the variance with the suggestion that the Architectural Review <br />Board seriously consider continuing the same style of architecutre <br />and landscapinge The motion was seconded by Mr. Horvath. At this <br />point Mr. Fairfield questioned the advisability of granting the <br />variance when the garage is already encroaching 1$t into the set <br />back area. It was explained that the garage was there before the <br />school was built and that it would be difficult and costly to add <br />to the front of the buildinge The motion was approved unanimously. <br />Variance approved.
