M <br />j <br />1 ' <br />' BOARD OF ZONING APPEALS DECEP4BER 6, 1978 PAGE 2 <br />1. Charles D. Carder, 6039 Bellevue Ir. Request for variance (1133.13) <br />Request 2 ft. heightvariance for fence. Violation of Ord. 62733 <br />Section 1151.04 <br />Chairman Ledvina called all interested persons before the Board. <br />The oath was given. This property is immediately adjacent to 1480. <br />The appelant wants to construct a 6 ft. fence on the north side. <br />of property down to the front of his house along the rear property <br />line a distance of 74 ft, and with an approximate 15 ft. jog toward <br />the south. Mr. Carder explained that he was planning to put in a <br />swimning pool eventually. Mr. Carder's neighbor to the rear <br />objected to the fence along the rear line. It was observed that <br />the request was premature since 1480 was not near completion and <br />no permit had been applied for for the pool at which time a 6 ft. <br />fence would be required. Discussion continued. Mr. Remmel moved <br />to reject the request. Mr. Fairfield seconded it. Piotion passed <br />unanimously. Request denied. <br />2. Zivorad Djordjevic, 6229 McKenzie. Request for variance (1133.13). <br />Request 1 ft. height variance for fence. Violation of Ord. 62-33 <br />Section 1151.04 (h) 1. <br />Chairman Ledvina called all interested persons before the Board. <br />The oath was given. Mr. Djoredejevic, rep-r-esented by'the,contractor, <br />wants to put in a solid brick fence 5' high on the south side of his <br />driveway. Neighbor adjacent to the wall objected on the basis of <br />security and air flow in the summer. Discussion continued. Mr. <br />Fairfield moved that the motion be rejected, seconded by Mr. Remmel. <br />Motion passed unanimously, request denied. <br />3. Gerald Koenigsmark, 30681 Lorain Rd. Request for variance (1133.13). <br />Violation of Ord. 62-33, Section 1151.04 Sub Par. "C'.; (exceeding <br />750 sq. ft.). Also, request for special permit to add to non- <br />conforming dwelling. Special permission req uired by Ord. 62-33 <br />section 1231.02. Chairman Ledvina called all interested persons before the Board. <br />The oath was given. The garage:being p'raposed- is _1680 .sq. ft: • <br />The puxpose is to store antique cars. Mr. Gundy, Building Com- <br />missioner, explained that the property is zoned commercial b ut <br />is certified for occupancy as single residential but zoning could <br />be changed for commercial business purposes. Mr. Ledvina moved to <br />to reject the request.,:,Mr.peVoto seconded. Request denied. ' <br />4. Richard Rogalski, 3183 W. 231 st., Request for special permit to <br />add to a non-conforming dwelling. Special permission required by <br />Ord. 62-33 Section 1231002. . <br />Chairman Ledvina called all interested persons before the Board. <br />The Oath was given. It was determined that a variance for 7 ft, <br />set back on the rear yard would also be needed. Mr. Ledvina <br />observed that this is a very wide rear yard. Mr. Remmel moved <br />that a 7 ft rear yard variance and a special permit to add to a <br />non-conforming dwelling be granted. Seconded by Mr. DeVoto and <br />unanimously app rovede <br />
