r <br />BOARD OF ZONING APPEALS DECEMBER G, 1978 PAGE 3 <br />5. Donald L. Borger, 23066 Stoneybrook. Request for variance (1133.33) <br />for tool shed already.constructed. Reauest for 2 ft, side variance <br />8 inch heiaht variance and 12 sq. ft. floor variance. <br />Chairman Ledvina called all interested persons before the Board. <br />The oath was given. Mr. Ledvina explained that the tool shed was <br />already constructed at the rear of the property. The request for <br />the side yard variance should be corrected to 2 ft. 711 inches. - <br />Mr. Borger claims he was told by the Building'Department that he did <br />not need a permit if it was under 100 sq. ft. and that it should be <br />5 ft. off the side property line. Mr. DeVoto observed that he still <br />did not stay within the guidelines that he was aware of. Discussion <br />continued. Mr. Remmel made a motion that the three variances be <br />granted based on one of two things: that a foliage screen at least <br />8.ft. high with at least 4 trees be planted in the next 60 days <br />or a woven wood screen, at least 12 ft. wide and 6 ft. high, be <br />erected on the street side of the tool shed. Mr. DeVoto seconded <br />the motion. Roll call on motion: Mr. Remmel, aye, Mr. DeVoto, aye, <br />Mr. Ledvina, nay, and Mr. Fairfield, nay. Motion failed to pass. <br />Request deniedo Tool shed is con-conforming and has to be moved, <br />6. Raymond W. Boodey, 4449 Birch Circle. Request for variance (1133.13). <br />Request rear yard variance for tool shed. Violation of Ord. 75-117. <br />Chairman Ledvina called all interested persons before the Board. <br />The oath was given. Mre Boodey wants to construct a tool shed on <br />rear property line. It was noted that the rear property was a <br />school yard and this would have no effect on any other property <br />owners. Mr. Boodey gave his reasons. Mr. DeoVoto made a motion to <br />approve the variance, Mr. Fairfield seconded, and the motion passed <br />unanimously, variance granted. <br />7. Robert D. McFarland, 5914 McKenzie Rd. Request for varianr.e (11.13 <br />Violation of Ord. 62-33, Section 115.04 Sub Par. "C" (exceeding <br />750 sq. ft.). <br />Chairman Ledvina called all interested persons before the Board. <br />The oath was given. Mr. McFarland is asking for a 42 sq. ft. <br />variance for a second garage for a tractor. It was observed that he <br />had a very large piece of property. Mr. Fairfield moved that the <br />variance be granted, seconded by Mr. Remmel, unanimously approved. <br />Variance granted. <br />8. Philip J. Rozzi, 28719 Knickerbocker Rd., Bay Village, OH. Request <br />for variance (1133.13). Request to reduce size of rear yard at <br />permanent parcel 235-13-25 by 24 ft. Violation of Ord. 62- 33 <br />Section 1163.01. Request for variance (1133.13). Request_to reduce <br />side yard 2 ft. Violation of Ord. 62-33 Section 1161.01. Also, <br />request for variance (1133.13). Request to reduce square footage <br />25 sq. ft. (1060 sq. ft. required) Ord. 62-33 Section 1153.02. <br />Chairman Ledvina called all interested persons before the Board. <br />The oath was given. The construction of this house would allow only <br />a 16 ft. rear yard. Mr. Ledvina observed that it was too much house <br />for the 40 fte lot.
