.?. . .' . <br />CITY OF NORTH OLMSTED <br />NOVEMBER 1, 1978 <br />-- r <br />BOARD OF ZONING APPEALS - MINUTES <br />Chairman Ledvina called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman Ledvina, Mr. Remmel, Mr. Horvath, and Mr. Fairfield <br />ABSENT: Mr. DeVoto <br />ALSO PRESENT: Law Director Gareau, and Building Commissioner Gundy <br />Mr. Remmel made a motion to approve the minutes of October 4, 1978 as submitted, <br />seconded by Mr. Horvath, unanimously approved. <br />1. Fisher Fazio's, 4700 Gr.NortheBlvd.,North Olmsted, Ohio. Request for variance <br />(1133.13). Request is to build a new dock paralled to building. Violation of <br />Ordin. 62-33, Section 1214v02 (Setback of loading dock from single residential <br />zoning.) • <br />Chairman Ledvina called al1 interested persons before the Board. The oath was <br />given. The request was explained. Several people questioned the location of <br />the dock. After discussion, it was determined that property owners most af- <br />fected by the request were not notified. Mr. Remmel made a motion to postpone <br />this hearing until the next meeting so that proper notice can be served. <br />Seconded by Mr. Fairfielde Unanimously approved. <br />2. Marian Evanco, 24905 Chase Drive, North Olmsted, Ohio. Request for variance <br />(1133.13). Request is to build an attached garage 4' closer to adjacent house. <br />Violation of Ordin. 62-33, Section 1161.02, which requires 15' separation, and <br />15' total. <br />Chairman Ledvina called all interested persons before the Board. The oath was <br />given. The request was explained. After discussion, it was determined that the <br />total side yard would be in violation. Four foot variance needed in adddi.tion <br />to original request. Single garage would require no variance. Motion was made <br />to reject the request by Mr. Fairfield. Seconded by Mr. Remmel. Unanimously <br />approved to reject. <br />3. Sparky DiBenedetto, 23203 Lorain Road, North Olmsted, Ohio. Request for variance <br />(1133.13). Request for setback variance in violation of Ordin. 62-33, Section <br />1174.03, and for Parking Lot variance, in violation of Ordin. 62-33, Section , <br />1213.01 (e), for Taco Villa Rest. on PP#232-26-11, Brookpark Extension, North <br />Olmsted, Ohio. <br />Chairman Ledvina called all interested persons before the Boar. The oath was <br />given. P1ans were distributed, and members were shown the correct location. <br />Mr. Fairfield had received wrong location map. Members expressed concern of <br />future problems in the event easement rights are terminated. Majority of parking <br />shown is off the property owned by appellant. 'I'he property to be leased is owned <br />by Capitol Bank. Mr. Fairfield made a motion to reject the request seconded by <br />Mr. Ledvina. Unanimously approved to reject.
