BOARD OF ZONING APPEALS SEPTEMBER 6, 1978 _ PAGE, 4 <br />Chairman Ledvina requested all interested persons to assemble before the Board. <br />The oath was administered. Proposal is for a 27' x 16o8t addition to rear of <br />the propertye Request is for 11'8" rear yard variance. Mr. Ledvina felt this <br />was a very big addition. Mrm F airfield commented on the fact that he did not ,. <br />feel this addition would disrupt the unity of the back yard and was not out of ?. <br />context of what already existed in the neighborhood. Mra Ledvina stated this <br />would be one of the largest variances the Board ever gave for a rear yard structure. <br />Mr. Ledvina moved to deny the above request for variance. Mr. Remmel seconded. <br />Roll call on motion: Mr. Ledvina, aye, Mr. Remmel, aye, Mr. DeVoto, nay, Mr. <br />Horvath, nay and Mr. Fairfield, nay. Request was granted. <br />1\ <br />' 10. Zac7: W. Smith, 6051 Forest Ridge Road, Request for variance- (1133.1-3). Request <br />for 5' side yard variance for construction of. a single dwelling 1-i0use with detached' <br />garage:. Ttwenty foot side yard required. - Violation of ord. 62-33 section 1161.-O1. <br />? Chairman Ledvina requested allinterested persons to assemble beforethe Board. :The oath was administered. Request is not for a 5t side yard variance as stated <br />in the agenda but for a combined side yard of 20'. Mr. Zack will only have a <br />total of 15' combined side yards and with a detached garage he is req uired to <br />have 20' combined side-yards. Mr. DeVoto moved to grant the variance. Mr. Horvath_ <br />seconded and motion passed unanimously. _ <br />11. Yong H. Jung, 23521 Carriage Lane: Request for variance-(1133.13). Request for <br />8' high fence-in rear--yard. Violation.of ord.._62-33_section 1151.04(H)2. <br />Chairman Ledvina requested all interested persons to assemble before the Board. <br />The oath was administered. Mrs. Jung is requesting an-8' fence for privacy <br />reasons as well as to keep her childreri confined to her own yard. A number of <br />Mrso Jung-'s_ neighbors_ came_ befor-e the_ Boar-d-=in=-protest of- the proposed fence. - <br />Mr. Ledvina made the-observation that Mrs. -Junghas hedges which constitute a <br />fence along both sides of her sideyard-and__these hedges are 8' tall and are <br />in violation of the ordinance-Mro Ledvina'=•alsn=_stated °that==as -long as -he had <br />been - on the Board- they= had not granted °an-=approval-===for an =8'-__ -fence : unless_ -it <br />was for a commercial es"tablishment;--Mr._Fairfield moved to deny the request=-- _ <br />and that -it--also be-noted in=-the =mi?nutes-that=attention -is_ called to_,the fact. that <br />the hedges are in- vi.olati-on as- the=ci=ty-=requi-res.--a hedge- must .not be-_ more-=than 4' <br />high. Mr. Horvath=seeonded=and motion passed-unanimously-o--Request-denied-.---- <br />12. - Thomas F. Trefz;:`28183-Wisteria:= - Request_ for- vari-ance--_(11:33.-1-3)-.-- Request -for ___ <br />2'6" =side-yard_varian-ce-_f.or -existing-- tool.shed._--Violation of -ord:-= 62=33._section-=_ <br />1161:D1. - <br />Chairman Ledvina requested the applicant and all other in-terested--persons to- - <br />assemble before=the Board. The oath was administered. Mr. Ledvina wished to <br />clarify-_the point as to whe-ther _this was an existing --tool--shed_or 'an addition <br />to -an existing dwelling. --Mr. Gundy-_stated it is to-:be-regarded as- a-tool- shed. - <br />Building department records show no bUilding permit was issued_for the construction <br />of said. tool- shed._ Mr. Trefz brought signed= letters _from _his neighbors stating _ <br />that they are in_agreement with Mr. Trefz in that the present placement of the <br />tool shed is in the best location possible so as to_conceal it_from_their view. <br />Mr,.Trefz cannot move his tool shed to within the lO" requirement of his rear-. . <br />-- property line.because of a swale which runs-across the rear.of his property <br />line.--Mr. Remmel.moved.to grant a variance to-locate the tool shed so that--. <br />one wall be no more than 22' from the rear property line. Mr. Fairfield seconded <br />and motion passed unanimously. Mr.-Trefz was given 30 days to remove the tool <br />shed.
