Violation of Orda No. 62=33 Section <br />1157.01 (frontage) and Section 1159.01 -(70 ft. maximum setback). <br />Chairman Zedvina invited the applicant and all other interested persons to as- <br />semble before the Board. All witnesses, before testifying, were sworn in. Plans <br />were studied and discussed. Several neighbors appeared before the Board object- <br />ing to the plan. After discussion Mr. Remmel moved to grant special permission <br />to allow subdivision of non-conforming lot and to allow variance of continuance <br />of approximately 300 ft. on Sub Lot #2. Mr• Huntington seconded the motion.Roll <br />Call: Messrs. Remel, Huntington and Ackley, aye; Mr. Ledvina, nay.Motion passed, <br />request granted. Motion was amended to include "based on the granting of subdi- <br />vision by remaining city authority". <br />2. Plans <br />were studied and discussed. Property behind is church property. Fence is two yrs. <br />old. Proximity of fence to line is cause of non-conforming. Mr. Ledvina moved to <br />approve existing fence - 2 ft. height variance and 32 ft. sideline variance.(Mea- <br />surements are not to be construed as permission to add to existing fence.) Mr. <br />Huntington seconded, and motion passede <br />3. Edmund and Barbara 0'Brien, 23519 David Dr. Request for variance (1133.13). Re- <br />quest for lh ft. rear yard variance. Violation of Ord. 62-33 Section 1161.01. <br />Chairman Ledvina invited the applicant and all other interested persons to as- <br />semble before the Board. A11 witnesses, before testif,ying, were sworn in. A 14 <br />ft. x 32 ft. addition is planned, eliminating almost 4 of rear yard. After short <br />discussion Mr. Huntington moved to deny the request for variance. Mr. Remmel <br />seconded the motion. Roll Call: Messrs. Huntington, Remmel, Zedvina, aye; Mr. <br />Ackley, nay. Request denied. <br />4. Edward L. Zeh, Jro, 4415 Selhurst Rd. Request for variance (1133.13). Request <br />for special permission to add to non-conforming garage. Special permission re- <br />quired by Ord. 77-129 (1132.12 amended). <br />Chairman Ledvina invited the applicant and all other interested persons to as- <br />semble before the Board. All witnesses, before testifying, were sworn in. Plan <br />is to add 19z ft• on rear of garage. After short discussion Nh°. Remmel moved to <br />grant special permission to allow addition to non-conforming garage and variance <br />to all construction per plans within the 5 ft. setback area. Mr. Ackley second- <br />ed, and motion passed. Variance granted. <br />5. Mr. and Nlrs. Gary Allen, 4341 Canterbury Rd. Request for variance (1133.13).Re- <br />quest for special permission to add to non-conforming dwelling (79 ft. setback). <br />Special permission required by Ord. 77-129 (1132.12 amended).
