?l ?'?1 ? <br />/ <br />CITY OF NORTH OI,MSTED, OHIO <br />BOARD OF ZONING APPFATS <br />The April 6, 1977 meeting of the Board of Zoning Appeals was called to order by Chair- <br />man Ledvina promptly at 7:30 p..m. <br />Present: Chairman Ledvina, Plessrs. Hamill, Huntington and Remmel. <br />Also Present: Mr. Gareau, La,w Director, NTrs. Saringer, A'!r. Fairfield, Mr. I•!ilamosky, <br />Council Members, and Mr. Gundy, Building Commissioner. <br />Referring to the minutes of the March 16, 1977 meeting, Chairman Ledvina requested <br />that the Building Dept. send a letter of reprimand to the Caldwell Della Vella Bldg. <br />Co. as mentioned. Mr. Hamill mQUed that the minutes of March 163 1977 be approved as <br />writtena Seconded by Mr. Remmel. RoTl Ca11 on the motion: Al1 members voted yes. <br />l. Peter N. Palos, 280412 Angela;Dr, Request for variance (1133.13). Request to <br />build fence 5 ft. high (sides)e Violation of Ord. 62-33 Section 1151,04. <br />Chairman Ledvina invited the applicant and all other interested persons to assem- <br />ble before the Board. All witnesses, before testifying, were stiaorn in, Mr. Pal- <br />os submitted a signed statement from six adjacent neighbors with no objections <br />to his propoSal, The Boa'rd determined that this request supplements the vari- <br />ance of March 2, 1977 and is for the side property lines only. After discussion <br />Mr. Remmel made a motion to deny the variance. There was no second. Further <br />discussion arid Nlr. Hamill made a motion to approve the variance, seconded by Mr.. <br />Ledvina. Roll Call on the motion: Mr. Hamill, yes; Messrs-. Ledvina, Hunting- <br />ton and Remmel, no. Variance not approved. <br />2. Scott Nlanley, 3547 Z?'alter Rd. Request for variance (1133•13)• Request to ex- <br />tend side yard variance 10 ft. to the fron-t in addition to variance granted 2- <br />2-77. Violation of Ord. 62-33 Section 1161.01. <br />Chairman Ledvina invited the applicant and all other interested persons to as- <br />semble before the Board. All witnesses, before testifying, were sworn in. The <br />Board determined there was little change in testamony and evidence from the pre- <br />vious hearing. N1r. Hamill made a motion to approve a five ft. addition forward. <br />No second. N1r. Huntington made a motion to deny the variance, seconded by MT'. <br />Hamille Roll Call: All members voting yes. The variance was denied. <br />3. Kenneth W. Whitely, 23041 Summerland Ave. Request for variance (1:133..13). Re- <br />quest to build fence 6 ft, high. Violation of Ord. 62-33 Section 1151.04. <br />Chairman Ledvina invited the applicant and all other interested persons to as- <br />semble before the Board. All witnesses, before testifying were sworn in. After <br />a short discussion Mr. Huntington moved to deny the request; seconded by Mr. <br />Hamill. Roll Call: All members voting yes. The variance was deniedo <br />4. Charles L. Novachick, ?6010 Porter Rd. Request for variance (1133.13). Request <br />for variance for distance between house and garage. Violation of Ord. 62-33 <br />Section 1151.% (C).: <br />Chairman Ledvina invited .the applicant and all other interested persons to as- <br />semble before the Board. All witnesses, before testifying, were sworn in. The <br />Board discovered that an additional variance of 4 fts was needed and the appli- <br />cation was amended accordingly. The applicant stated the impossibility of mov- <br />ing the garage, the rieed for tYie added space, and the neighbors are not concern-
