J <br />City of North 011msted <br />BOARD OF ZONING APPFALS <br />March 3, 1976 <br />Chairman Ledvina called the meeting to order at 7:30 p.m. <br />Present: Chairman Ledvina, Messrs. Huntington, Olson and Hamill. <br />Also i'resent: Building Commissioner Gundy, Law Director Gareau and Recording <br />Secretary Hodgins. <br />Minutes of February 4, 1976 were consideredo Mr. Huntington moved to approve <br />minutes as submitted. Mr. Hamill seconded and motion passed unanimouslye <br />l. Dean rlood, 4304 Clague Rd. Requesy for variance (1133•13)• Request to <br />build horse stable less than required distance from adjacent dwelling. <br />(Proposed stable would be approximately 140 ft. from garage apartment at <br />4282 Clague Rd.) Violation of Ord. 62-33 Section 1151.01 (E) requiring <br />200 it. <br />Present: Dean rlood and Glenn Limpert. Case and appeal were reade Wit- <br />nesses were administered the oath. Records show Mx. Limpert was <br />aranted variance by this Board for the apartment on August 23 <br />1972, Plans and appeal were studiedo 1?7r. Flood stated final <br />closing date for his nurchase of nropert.y was in October of 1972 <br />and he had researched and found no documentation of existing a- <br />partment. Robert Kall was administered the oath at this time. <br />He stated he has no opjection to Mr. Flood°s building a stable. <br />Mr. Olson moved the garage is not a legal residence and therefor <br />case should be dismissed for lack of legal jurisdictione Mr. <br />Hamill seconded and motion passed unanimouslyo <br />2. S. DiBenedetto, 26701 Brooicpark Fxtension. Request for variance (1133.1?). <br />Request for variance for distance between a food establishment and a veteri- <br />narian clinic. Violation of Ord. 62-33 Section 1173.02 (D) (7). <br />3. S. DiBenedetto, 26701 Brookpark Extension. Request for variance (1133.13)• <br />Request for variance for distance between a food establishment and a pet <br />shop. Violation of Ord. 62-33 Section 1173.02 (D) (7). <br />Cases to be considered together. <br />Present: S. DiBenedetto, Dr. Kosmer and Mrs. Zippe Witnesses were administer- <br />ed the oathm Cases were readm Mr. DiBenedetto stated building is <br />completely insulated and soundproof; there is no objection from other <br />tenantso He also stated leases would be restrictive. <br />Mr. Olson moved to grant variance for distance between a food es- <br />tablishment and a veterinarian clinic with condition there be no <br />boarding of animals except for overnight as a result of surgery. <br />Ivlr.
