.4 <br />Board of Zoning Appeals - December 6, 1960 - Page 2 <br />Mr. Clarence Oviatt,-City Solicitor, was now present and offered the following <br />legal opinions: The use of ldest 231 Street for access to the property for <br />business purposes is tllegal. Our ordinance preclwdes the use of two residences <br />on the same singie lot; and therefore, the appellant,is illegally living in the <br />second rear house as long as.the front house on the lot is occupied. The front <br />house on the lot has been vacant for more than a month. The present 50-foot steel <br />radio tower is illegal, but the Board has the authority to grant a variance for <br />this tower. <br />Appearing in opposifiion: James Lawrence - 3514 West 231 Street <br />Charles Walczak - 3496 West 231 Street <br />Mrs. Russell Miller - 3171 West 231 Street <br />Loui s Herman - 3433 West 231 Street <br />The objections of these residents were all regarding the manner in which the <br />appellant operates his business and maintains his property, over which the <br />Board has no jurisdiction. <br />Mr. Oviatt suggested that the Board table the public hearing unfiil some of these <br />objections can be rectified by the appellant and the property owner, Mr. Dindia; <br />can be notified of the situation and his permission obtained to close off the <br />Llest 231 Street dr i veway for cormnerc i al use. It was moved by Mr. Morgan and seconded by Mr. Greene that there be a continuance <br />of this pubtic hearing until 7:30 p.m. December 12, 1960, to give the appellant <br />an opportunity to rectify the items which have caused complaint and also to <br />contact the property owner Mr. Dindia. <br />The motion was unaniroously approved. <br />4. Westlake, Ohio <br />The appellant requested permission to build a one-story apartment building on <br />the first lot north of 3492 Clague Road, North Olmsted, Uhio. The reason for <br />rejection of the permit was a proposed driveway providing access to Clague Road, <br />which is zoned for residence, and also that the appellant needs 2,000 more square <br />feet of iot ar.ea for the number of apartment units he intends to construct. The <br />appellant proposes to provide space for guest parking on the lot. <br />It was moved by Mr. Morgan and seconded by Mr. Byers that the matter be set for <br />public hearing on January 3, 1960, at 7:30 p.m. <br />The motion was unanimously approved. <br />5. Appellant: Carol A. Greenwood - 5600 Columbia Road <br />North Olmsted, Ohio <br />The appellant requested permission to erect two post lights, 12 feet high, one <br />on either side of the driveway, and an awning to cover cases of beverage in the <br />rear of the sfiore. The store itself is now a non-conforming building in a <br />residential zone. <br />It was moved by Mr. Morgan and seconded by Mr. Greene that a public hearing be <br />set for January 3, 1960, at 8 p.m. The motion was unanimously approved.
