His home is on the <br />lot now and would have 92.741 frontage after division. Upon examining'the:plans <br />it was noted tha t actual depth of lot was 123.85+ and not 133.85' as specified <br />in the application. Neighbors present were Mr. Steiger9 5125 Colnrabia and Mr. <br />.Ackerman, 5121 Col.umbia. 2'hey had no objection to a home built on 801 vri.dth <br />lot, providing front yard setback,,would be maintained, back yard would line up <br />witki theirs and house, wi.th attached garage, would be comparable in valuation <br />z,ji.th the othe rs in the neishborhoDd. Nr. Nelson moved to grant the variance, <br />as per plan. Tfr. Klinite secondede Unanimously passed. <br />3. Appellant; Brennanls Auto Body, 25044 Lorain Rd., North Olmsted <br />Ref: Request for variance to construct on the t,op of and at rear of exist- <br />ing building, an entertainment hall to be rented to the general pu.blico <br />Existing buiZding has setback of 401. iiequest is in vi.olation of <br />Section 1174.02,$ which states in retail business district building <br />setback shall be at least 50t from street line; Section 1231.01 <br />and Section 1231.02 (Sub B) which states a nonconforrning building <br />shall not be altered' added to or enlarged unless the additions <br />and original build:ing are made to conform to the yard, coverage <br />and height regulations of the d.istrict in wnich i_t is located. <br />Mr. Brennan presented his plan for adding.., to the existing building. He felt <br />it would be a good source of revenue and addition wou7.d be in keeping with the <br />building, which is only 3 years old. Black topping would be put in rear for <br />parking. <br />Neighbors and nearby lot owners present wereo Mre Henry Janik, 24940 Lorain, <br />Mrs. Focsik, 25050 Lorain3 Mr. Geo. 3iddulph3 26005 Butternut, Nis. Phyllis <br />and Yiagdalene Green9 25069 Lorain, and 14rs. I B. Brackenridge3 24963 Lorain. <br />Mrs Klinite explained to 14r. Brennan that the Board of Zonsng Appeals had no <br />alternative but to turn down his request for variance. On the basis of the <br />Law Director's ruling, a nonconforming building shall not be altered, added <br />to or enlarged unless -the existi.ng building is first rrade to coru"'orm to the <br />yard, coverage and height regulations of the district in which it is located. <br />F:e further explained that upon receiving a denial from the Board of Zonirg <br />Appeals, Mr. Brenna.n could take the appeal to court, <br />Mr. Nelson moved to deny the variance on the basis of the I,aw Dixector 's <br />ruling on nonconforming buildings. Second by Mrs. Eian, Vote Vras unanimous. <br />4. Appellant: Mr, Carl Endreola' 37045 Chagrin B1vd., Clevel.and <br />N.ef; Request to erect a building east of 25563 Lorain N,d. Proposed build- <br />ing would be 80' wide by 60' in depth, with a setback of 641 for <br />parlcing in front. Rear yard would be 161. Request is in violation <br />of Section 1174.06' which reo,ui.res a rear yard of at leas t 50, shall <br />• be pro vided if any part of the rear line is adjacent to residence <br />district.
