Appe].lant: Matherson B1dg. Co., 23560 Lorai.n Rd., North Olmsted <br />Ref: Request for permit to build a home for Mrs. Lydia Casmer, 3619 <br />W. Park 7ro9 Cleveland, Ohio9 on S/L 172, which is located on the <br />cornex° of Porter Rd., and Northern Ave., North Olmsted. This <br />corner lot is 401 wide. Proposed hore is 24' x42 1. Appellant <br />is requesting a 111 setback to proposed extension of Northern Ave. <br />This does not conform with Code as set iorth in Section 11590029 <br />Vrhich states the minimum setback on the street upon which the <br />side of the house faces shall be 25'e <br />^1 his appa al was pos tponed from the regular mee tang held on February 2, 190 0, <br />in order that members of the Board might see the lot in question and that 14r. <br />Kitchen' Law Directore could be present. Minutes of the September 15o 19659 <br />meeting pertainirig to this case, were read. These minutes covered the second <br />appeal made by the owrxer of this lot for an identa.cal variance' request ior <br />which was denied. At that time the appellant was informed by the chaixm an <br />of the Zoning Board.9 that she had one more appeal' that to the Common P1.eas <br />Court. A1so' she could contact tYm Site Committee of the Councilo <br />In answer to the question as to why this case was brought before the Zoni.ng <br />Board agains NIr. Nudelman of the TIat,herson B1dg. Go., said that he had <br />appealed to the Mayor suggesting the dedicated land for PJorthern Ave, be <br />#acated. He was referred to the Planning Co;nmi.ssion and they suggested he <br />go before the Zoning Board of Appeals again. Ci.ty Engineer, Mr, Labas., when <br />contacted, stated the City does not plan to vacate Northern Kve. <br />P4r' Mang2ni' Councilman' stated that inasmuch as it is now dej'inite that <br />S/Z 172 cannot be enlarged, he fel.t this presented a hardship caso and owner <br />should be allowed the variance to build as requested. He said that she has <br />been billed $365 as an assessment for sanitary sewer connaetion9 and inasmuch <br />as the City has recognizec3 tkiis lot as a lot on which a house cari be bu3.lt., <br />he felt she was entitled to make due use of the properi,y. <br />Mr. Berg of Burns Rd.9 felt it was not a hardship case. Mr. Gxeene stated 1e <br />had received a ca1,1 from Mr. Walter Stevens' whose property abuts to the <br />south on Porter$ that he objected for the same reasons which he presented <br />in the 1etter t,o the Board and which was read at the meeting February 2'1966. <br />• <br />,,,
