Minuted,: Special Meeting, Board of loning Appeals' Februaty 16, 1966 <br />Page 2 <br />Mr. Nudelman s tated the plans did not show a garage but one would be built, <br />? attached to rear of home, measuring llt' x 201. He said his intention was to <br />place gravel on unimproved 1Vorthern and entrance to garage would be from <br />there, The point was brought up that with 11' setback' this would not alloii <br />for offstreet parking in the drivewajr. as 171 is needed to get car off side- <br />walk. The street as plan.ned and irhen eventually improved9 would be too narrow <br />to al.low for street parkingo <br />Mr, Seheeff fe)t -vthe:boar.ii:was in a position that it would have to recognize <br />this as a hardship case and under some set of conditions, as buildable pro- <br />perty. <br />A suggestion was made b9 the Board that the open ditch could be til.ed and <br />3.£ owmer were to purchase tile accordi.ng to city specifications' the city <br />would put it ine thus allowing for the building of a detached garage. A <br />detached garage, •i?l.' built on part of the ditch easement, would be allowed <br />but oiTner must sign an aff?.?dAvit allowing ei.tY to remove tile or portions <br />of garage in case of necessity. <br />A discussa.on followed„ eomerning the size of tY-- home0 It was pointod out <br />that a 12 story home would more nearly approximate livable first floor space <br />requirements in B district and be comparabls to those in the area. A variance <br />would be required in order to build a home to meet code dinen?sionso Also' a <br />variance woul.d be needed if garage were attach,Ed to rear of home, for a <br />rear 3Tard setback. <br />Mr. Nelson moved to deny the variance of 111 setback. Rinella. They were represented by Mr. Nicholas <br />Zajack, architect. He stated addition was necessary as more space was <br />needed for seatzng with an increase in bu53.ness, <br />Mr. Kitehen refer•red the Board to Sections 1231.01., 1231v02 (B) and 1231,03(B), <br />ltThen asked for his op3n3.oiz' he gtated the Zonsng Board di.d not have tYm author- <br />ity to rule one or grant any variance which pertained to nonconforming build- <br />ings, <br />Mr. Byers mojred that we deny the appeal for variance due to th-, fact that <br />the Board of Zoning Appeals is specifically denied the right ta ruls other- <br />• wi.se by the Zoning Ordinance.
