Minutes <br />Board of Zoning Appeals <br />April 6, 1966 Page 5 <br />? 11. Appellant: Concvrd Corpo, 14305 Washington B1vd., Una.versity Hei.ghts 18 <br />Refa Request for variance to build a home with attached garage <br />on S/L 66., 24100 Noreen Dr., North Qlmsted9 with front yard <br />setback of 40t. Lot is corner Noreen and Hawkinse Depth <br />of 1ot., 1191. Request is in violation of Section 1159.01' <br />which requires 501 front yard setback. <br />Mro 2`ulley Lapidus represented his company. He said adjacent house has 40s <br />setback. Iot has 80' .frontage on Noreen., 88.87 facing Hawkins. In examining <br />the plans of the split level., it was noted the bedrooms on the upper floor <br />had a 21 overhang on the front of the house and 1' on the rear of tYm house. <br />Depth of the rear yard, is 531. Mr. Lapidus agreed to move home back 21., <br />thus the front yard depth woulcl be 401 to the overhang.. Rear yard would be <br />51!, or 500 to t,he overhang at rear of home. <br />Plans show a 201 setback on side yard to Hawkins., whic h is permissible as <br />plans were approved by Planning Commission. As the plan.s show 16,411 to the <br />west sidelines it was suggested the house be moved west 51' giving a 25' <br />sideline to Hawk i ns. <br />Mr. Nelson moved to grant the varianee., with house being moved back 5' from <br />Hawkins to maintain a 25, side yard on Hawkiris. Second by Mr. ]3yers. Vote <br />was unanimous. <br />Mx°. Gundy presented a permit for a home issuQd in 1961. The home has recently <br />changed ovmers and a title search is being made. The titl.e eompany states <br />because the house has an eave extensiong this constitutes possible encroach- <br />ment on code setback requirements. <br />After referring to sections in the code pertaining to the definition of a <br />building line9 the Board selt that this did not constitute encroachmerit of <br />the building line. <br />14eeting adjourned at 11_o'clocko <br />u <br />William J.
