Board of Zoning Appeals, December 7, 1966 <br />Paoe 2. <br />3. Appellant: Franklin Bros. Realty Co., 21010 Center Ridge Road, <br />Rocky River. <br />Request for variance (1133.13) to build a home at <br />4316 Brendan Lane, North Olmsted, (corner lot) which <br />will be 101 from Reed Avenue. Request is for 15' variance. <br />Request is in violation of #62-33, Section 1159.02, which <br />requires minimum setback on the street upon which the <br />side of the house faces shall be 25'. <br />Mr. Alex Franklin was present. Mr. Voldrich, 4303 Brendan Lane, and Mr. <br />Weiskittle, 4291 Brendan Lane, were present and voiced their objection to <br />this variance. They said the proposed house's location vrould detract from <br />the appearance of the neighborhood and also obstruct vision for traffic and <br />be a hazard for the pupils of Sto Brendan's School. Mr. Greene read com- <br />munications from John Rieoer, 4267 Brendan Lane, and Iv1r. and A4rs. Steve <br />Demko, 4315 Brendan Lane, stating their objections. Mr. Scheeff made a <br />motion to deny this variance. Second by NSr. I'delson. Carried. <br />Mr. Greene announced that since the .Rev. Mre Canfield of the North Olmsted <br />Assembly of God Church was now present, the Board would hear his request for <br />permit. Mr. Greene read a petition with 25 signatures of various people in <br />the neighborhood who were against having this permit granted. <br />The Rev. Mr. Canfield stated that in his opinion churches do not downgrade <br />residential areas. At the present time his church has only 3 services per <br />week; that the dwelling would only be used temporarily for church services <br />and that they hoped to begin construction in early 1967 of a new church and <br />the present house would then be used as a parsonage. Mr. Norbert Fox spoke <br />for the people in the area and presented various objections to the permit, <br />such as parking problems, maintenance, noise, etc. He said there were other <br />churches in the area and one in particular did not make any improvements to <br />its property and he felt there should be no more dwellings used for this <br />purpose. <br />Mr. Gundy stated that churches may have permissive use in a single residen- <br />tial district but subject to this hearing and recommendations of the Board. <br />This hearing is not for the purpose of rezoning or variance. Mrs. Hodges <br />referred the Board to the map regarding the proposed Route 252, on which <br />the new church building would face. Mr. Greene read Section 1133.12 of <br />the Zoning Ordinance Code governing this request. The Rev. Mr. Canfield <br />replied that no one could fulfill these requirements, but they would cer- <br />tainly try. Mr. Gundy remarked that they were only seeking approval for <br />use of the existing dwelling now and that future plans would have to be <br />submitted before new construction could begina Mr. Scheeff said there <br />were too many contingencies in this matter and he made a motion to con- <br />tinue the hearing until the Rev. Pfr. Canfield could make siteplans avail- <br />able to the Boarde The Rev. Mr. Canfield said he would do so and Mr. <br />Nelson made a second to this motion. Carried. <br />4. Appellant: Carlson Furniture Co., 27178 Lorain Road, North Olmsted. <br />Request for variance (1133013) to have painted wall sign <br />on east wall of building. Sign Urould be approximately <br />4' x 40° with panel lighting. Request is in violation of <br />,#62-33, Section 1225.02 (C). Sign is over maximum permitted.
