Letters were presented from St. <br />Brend.an's Church stG.ting that they had no objection. Mro Iiirta.nen, a neighbor, <br />stated that he had no objectiona Mr. Nelson moved to grant the I71 variar_ce; <br />seconded by Mr. Byers and passed. <br />Q, Appellant= Hennie Homes, Inc. Rnquest to erect a house on SA 125 Kingston <br />Drive with a 451 rea.r yarc?. <br />Request is in violation of Ordina.nce #62-33, Section I163.0I, <br />a rear yard must be a minimum of 501. <br />Present: Mr. Puzzitello <br />Mr. Puzzitello ex-plained that the persons desiring to buy'.this house selected <br />this lot because of the recreation area at the rear. They dici not want other <br />houses behind them. However, the house selected can not be built on said lot <br />without a 51 rear yard variance. P4ro Nelson moved to grant the varia.nce; <br />seconded by Mrsm Eian and passed. <br />10. llppellant: Francis Murphy, 24158 Wooc'mere Drive. Request to build a <br />detached garage 10' from dwelling. <br />Request is in violation oi Ordinance #62-33, Sec'tion 1151.04, <br />a detached garage must be a minimum of 201 from d.welling. <br />Presnet: Mr. Stanley, Contr•actor <br />Mr. Stanley sta.ted that the lot was of irregular pie-shape and tha,t it would <br />be impossible to build a garage in any other location. Mr. Byers movec to grant <br />up to a 101 variance•, seconded by Mrs. Eia.ri a.nd passed. <br />11. Appellan to Nick Dadas., developer of Colbroolc Townhouses (Clareshire Drive), <br />to build 3-1 7 3/4" too close to setback Iine. <br />Reguest is in violation af Ordinance #62-33, Section 1159.01, <br />multiple dwellings must be set back a minimurn of 401. <br />Presents Mr. Dadas <br />Mrm Dadas e-xplained that due to a surveyor's error, the footers were already in <br />when it was discovered that the curve in the road was overlooked and that they <br />were 11 7 3/4" too close to the setback 1ine. Mr. Gundy brought to the attention <br />oi the Board_ the fact that this was a mixed-use district and that tlze plans for <br />Colbroolt Townhouses had been approved by both the Pla.nning Gorrmiission and City- <br />Council. He strted that possibly instead of this being just a sinple zoning <br />variance, it might constitute an amendment to plans and -that approva.T ma.g be in <br />conf'].ict -?,ith Ordinance #62-33, Section 1204.08. He felt the law director should <br />be asked to rule in this matter. Mrs. Eian moved to grant a. variance of 11 7 3/4" <br />provided that the Law Director be consulted to determine that it is not in conilict <br />with Sec'uion 1204.08; seconded by Mr. Nelson and passed. <br />Letters from the Safety Servi.ce Director and Building Commissioner were read <br />stating that the sign a.pproved at last month's meeting for the corner of <br />Brookpark--and Columbia. Roads on condition that it did not constitute a safety
