Page 3- Minutes Zoning Board of Appeals - May 18,1967
Board members discussed the fact that inasmuchas there are older homes
set back at less than required front set back, perhaps it would be
advisable to set the newer homes forward to eventually line up the
front yards on the street.
Mrs. Eian moved to grant a variance of 5' front yard and 11' rear
yard variance, seconded by Mr. Nelson. Unanimously passed.
7. Appellant Carpenter Homes, Inc. 33474 Center Ridge Rd,,No.Ridgevi11e,0.
Request for variance to build a dwelling on 5/L 399
and 2 of S/L 398 Decker Rd. North 0lmsted. Request is
for rear yard variance of 10'.
Request in violation of Ord. #62-33, Section 1163.01
which requires 50' rear yard.
Mrs. Eian moved to grant a variance of 10' front yard, no rear yard
variance, seconded by Mr. Roberts. Conditional that Building permit
will not be issued until letter is received from Mr. Rinyu that this
variance is satisfactory with himm
8. Appellant Bauer Develop.Inc. 2207 Devonshire Dr. Cleveland Hts.O.
Request for variance to build a dwelling at 6144 Croton Dr.
S/L 178 North Olmsted,0. Request is for reduction of
front yard set back from 60', per approved plat of Planning
Comm. and Council tQ 50' front set back. Request is
required by Ord. #62-33.
Councilman John West stated Council and Planning Comm. purposely went
along at developers request for 60' set back, iTould not like to see a
jagged front set back line, since we cannot specify kind of house the
builder will put up, as not hardhsip exists, and because he is firmly
convinced that another type home can be built on this lot which will
blend in with any existing house, and as 60' set back was at developers
request when originally platted, he wanted to go on record objecting to
this variance request.
Mr. J. Esgar of Plann. Comm, stated most of the Developers in presenting
plats to the Plann. Comm, shave down plat to get maximum number of lots,
and in some cases have to make changes to get building line required.
Plann. Comm, sets up the developments with thought in mind that the
Developer would not ask for variances after plat is recorded. Developer
could have requested this at time of Plann. Comm, meeting.
Mr. Bauer stated the original plat was set up for definite type home
according to requirements when subdivision was set up by Plann. Comm.
and Council and now larger homes are requested.
