Page 2 Zon. Brd. Appeals Regular Keeting Feb. 1,1967 <br />3. Appellant: Pir. I+Zongello, Kimberly Develop. Co., 6556 Louann Dr. <br />Request by Kimberly Development Co. for variance of <br />313" front yard setback on Sublot 36 and Sublot 37 <br />Zouann Drive. Violation of Zoning Ordinance which <br />requires 501 setback. <br />Pfr. Mongello representing Kimberly Develop. Co.' <br />appeared before the Board with reasons for request <br />for variance. bIr. Byers made motion to permit these <br />variances, seconded by A'Ir. Idelson. Passed. <br />4. Appellant: Request by Mr. Saul S. Biskind 10740 Broadvray, Cleveland, <br />Ohio, for interpretation of location of Buffer Strip, <br />to erect an gpartment Garage, Country Club Blvd. <br />14r, Biskind and NIrs Shur presented plat and shovaed the Buffer Strip in <br />question. <br />I?ir. Greene quoted Section 1203.05 of the Zoning Ordinance, (Development <br />Abutting a Residence Districto) <br />Adjacent neighbors living behind the section in question, present at the <br />meeting and objecting to the location of the garage in question were: <br />lQr. J. Hamm, l+Irs. &.PtlTrsm I4luzika, Yro & Mrs. Escar, NIr. & I4Trs. Barto, <br />I4r. & Iirs. Kocabv <br />Mr. Iiamm stated that prior to starting construction of the Shopping <br />Center Comple$ and during the time that the property noir being used <br />for Apartments was being considered for limited industry use, these <br />property owners met zTith Mr. Biskind and agreement was reached to <br />install 50' Buffer Strip, properly landscaped. <br />Iqr. Escar a member of the Planning Commission construed the Zoning <br />Ordinance and this request as an amendment to the Code, necessitating <br />referral to the PZanning Commission. <br />tIr. Biskind said Council listed as mixed use subsequent to dedication, and <br />questioned whether garage is residential use per Section 1203.05 of the <br />Ordinancee In connection wi,th garage is its use to be auxilliary use <br />for apartment, and terminology would correctly Iist this gsxage as a <br />multi-residence gaxage? <br />Mr. Shur stated garage is to be of finished brick 11 or 12 feet <br />high with trees to block viezf of garage, as this location of buffer <br />strip vras an engineering ma.stakev
