. <br />CITY OF NORTH OLINiSTED - BOARD OF ZODTING APPEALS <br />Regular Meeting held at City Hall ---- November 7, 1968 <br />The meating was caIled to order at 7:4,0 P.M. by Cliairman Richard Nelson. <br />Those Present: Mrs. Eian., Mssrs. Greene, Nelson, RobPrts <br />Also Present:. Mre Guz1dy., Building Commissioner <br />The minutes of I0/24/68 were approvecl as written. <br />Mr. Nelson announced that Saxon's Restaurant and Sam Dottore had withdrawn their <br />requests and that Topps Departr.lent Store had requested a continuance. Mr. Greene moved <br />to continue the Topps case to the next meeting; seconded by Mrs. Eian and passed. <br />l. Appellant: Guy Famolare, 6785 Chadbourtie Drive. Continuance of request for varia.nce <br />for existing auxillary building located on property. Present: . Mr. Famolare, Mr. Boncek, Mr. Hoffman, Mr. Wooc1, A2r. and Mrs. Guterrtann, <br />Mrs. Long <br />Mr..Nelson announced tha.t the City Law Director had replied to the Board's question <br />regarding their authority.in vicw of Bretton Ridge deed restrictions nrohibiting such <br />buildings. He stated tllat t'd.eed restrictions are a private lnatter between various <br />grantors and grantees. Any deed rPStriction.of Bretton Aidge Subdivision Are of no <br />concern to the municipal operation of the City of North Olmsted and should not be ta.ken <br />into consideration in -niy of the Boarq's deliberations". hlr. Fa.molare presented a <br />petition signed by a.pproximately 50 homeowners in the area who were in a.greement Trrith <br />the building being allowed to renain. The building in question was erected at a. cost of <br />SL 50 _a.nd Mr. Famolare wa s not aware tliat such a building was not aIlowed. Board members <br />who exa.minPd said building stated tl-iat it Fia.s very attractive Pmd clean but also pointed <br />out that it should ha.ve been 25' from tne side line on a corner lot and that it is not <br />the required dittance:;'fromi,'saia side line. Neighbors in attendance objected to the <br />building. Mr. Gr. eene pointed out tllat N*ariances are granted on tlae basis of harclship <br />caused bp the zoning code and stated tnat he cou].d see no hardship here other than a <br />financial one. He tllerefore moved to ci.eny the variance; seconded by Mr. Roberts and passed. <br />2. appellant: Joizn. Di4ichele, :4062 Fran- Street. R.equest to erect a detached garage <br />?t too close to side line a.nd 21 too close to rear property line. <br />Request is in viola.tion of Ordirian.ce 7#62-33, Seetion 1151.04 which re- <br />quires that a detached gara.ge be a:nini.mum of 51 from any property line. <br />Present: Mr. DiMichele <br />Mr. DiMichele presented a letter from Mr. Therens who lives next door to him stating that <br />he approves, of the request. Mr. DiP!Iichele went on -to expla.in that h.e has torn their o1d" <br />gara.ge down and that it was located aItnoSt on the side lot line. The conerete driveway <br />is lined up with the old garage location and he wishES to utilize it by btzilding the new <br />garage just 31 from the line. Ther..e is 35' between the house a.nd the proposecl garage but <br />it -uould be in line with the other garages along tlae street. Board.members .fe1t that the <br />garage being moved 21 forward to keep the required 5' from rear 1.ine ti;ould not be noticable. <br />Mr. DiMichele agreed that he could do this and would then neEd only a sideline varian.ce. <br />Mr. Roberts z:loved to grant a 21 sideline variance; seconded by Mrs. Eian and passed. <br />3. Appellant> Harxy Strauss, 28648 Holly Drive. Request to erect a fa.tnily room addition <br />a-t rear of existing dwelling 427' from rear lot line. <br />Request is in violatiotz of Ordina.nce 4462-33., Section 1163.01 wnicll <br />requires a 501 rear yard.
