Page 4-:_,;MINUTES BOARD OF ZONING APPEAL-S August 6,1969 <br />Attorney Dyson said that Mr. Swanson'was concerned with the neighborhood and <br />aia not want to install dog kennal or dog rv.ns and-that there were no deed <br />restri?tions to legally.?prevent these ins'tallations... Mr. Swanson noted that <br />a fencei3be in5talled 4' in height and the only problem.is the extra foot he <br />is requesting. <br />Rear neighbor, Mr. Walter Paulson objects to the installation of this fence, <br />and presented the Board with a drawing showing the rela,tionship of his property, <br />with the Swanson property. .,His objections were.; #1 - it was not symnetric, <br />#2 - he would` tie unable to conceal the. 5 ft. struc.ture'with. shrubs,.43 - it will <br />degrade his.property, #.4 -.a 5:foo:t. fence will not .restrain the dog., #5' - loss <br />of property value. _. / .' <br />Motion to deny the variance raas made.by Mr. Lancashire,.seconded by Mr. Davis. <br />Unanimous ly approved-. <br />9. Appellant:. Request for..variance`by Charles Yesberger, 2.485.4,Doe Drive, <br />North Olmsted to erect'an aftached garage6/10' too close to <br />side line. Request is in violation of Ord. #62-33, Section-. <br />1161,OT,.the sum of the two sides shall not be less than <br />, . 15' for:'a,dwelling_with,.attached garage... Mr. Yesberger,appeared b'efore the Soard and stated that due to insufficient <br />rear yard.property as.a result.of improper-. location of the City Drainage swale, <br />a detached-garage may not be sati.sfactorily buildt. As an alternative <br />solution,he intends to construct a minimum size attached garage and is asking <br />for 6/10 of one foot variance. It was deterniined by the Board that there were. <br />no objections;froin neigHbors.._ Motion was made by Mr. Greene to permit a <br />variance of 6/10 of one foot;;;.establishing the West set back as 9.4 ft. and <br />the East set back line as 5 ft. Seconded by Mr: Davis. Unanimously approved. <br />10. Appellant: Request for variance by Michael: Chakirelis-, 3411 Hvnter Dr. <br />North Olmsted to erect 50' of 6 ft..Basketweave fence along <br />.portion of,side lot line. Request is in violation of Ord. <br />#62-33;S"ection 1151.04,.fence not to exceed 4 ft. 'in height. <br />Mr.:Chakirelis appeared=before_the Board and requested the variance_for privacy <br />and wind break, and`.also to eliminate 'a severe snow problem during the winter <br />month's. Snow piles`up eausing loss of 'fime needed to.shovel before being,able ' <br />to get out.of the garage and driveway. Fe'nce-would'eliminate the drifts that <br />always occur during a heavy snow fall. A letter was read from Mrs. Hodgins, <br />Councilman Ward Z; recommending the allow,ance.of this variance. Appearing and <br />not objec.ting to this installation was Leonard Viggiani, Jerald Koenigsmark, <br />James E. Cowner, and John Badnoroski.. These neighbors said they have the same <br />snow problem. Objecting to the installation of this fence., was Richard Mecska, <br />the property owner on the side of.the proposed'fence. Chairman Roberts asked <br />Mr. Chakirelis if he was willing to extend the £ence to the rear property 1ine, <br />which he agreed.to. It was established that the Chakirelis dwelling and the <br />Mec,sko dwelling rear wall were in line., Motion was made by Mr. Davis to approve <br />a b,ft. snow fence constructed of basket weave material from the rear house line <br />to the rear property lot line. Seconded by Mr-. Lancashire..Unanimously approved. <br />.?'`.
