? .. ?? <br />Page.3 - Minutes Board of" Zoning Appeals August 6,1969 <br />Present and representing Sun Oil Co., Mr. Amsdale, Atty. a.nd Mr.. McKeown. <br />They proposed to replace,.the White.thorne rd. Station as the lease is, running <br />out. Submitted pictures showing colonial type building.with landseaping. <br />Interested'neighbors present were Mrs. Jordon, Mr. and"Mrs. Schmidt; Mr. Rowe, <br />and Mr. Porter. Mrs. Schmidt asked if the Sun Oil Station was a 24 hour <br />operation; Sun Oil was unalile to answer. Mrs..Jordan asked what the plans <br />were for the rest of the property. Mr_. McKeown said the other uses were <br />unknown. Mr,. Rowe asked who was representing the City,.inasmuehas they were <br />interested party.. Mr. Gundy said he represented the City at tlii5 meeting, <br />and the City Ac:tion had.been the refusal of the permit, Mr. Greene stated <br />tha.t he could see no hardship and made a motion-to deny'the request for <br />variance. Seconded by Mr. Davis. Unanimously passed. , <br />6. Appellant: Request for variance by Peter Castle, 6089 Somerset Drive, <br />` No'rth Olmsted.to erecfi an addition 4'10" too close to rear <br />lot line. Request is in.violation of Ord. # 62-33, Seetion 1163.01 which requires a 50' rear yard. - <br />Mr. Castle presented'a'rchitectual drawings and stated his`reason for request <br />wa"s for the purpose of additional.bedroom and family room areas. He consulted <br />his adjacent neighbors and no objections had been made. The plat and Architect- <br />ural plans were studied by the Board and it was observed that the homes to the <br />rear of this proper,ty were 400' plus in distance. Mot,ion was made by Mr.. Davis <br />to approve the 4'10" varianee as reques.ted, seconded by Mr.'Lancashire. <br />Unanimously approved.. ' <br />7. Appellant: Request for variance by Roy'Sturgeon,:3839'Clague Rd., <br />North Olmsted to erect 48' section of 6' ?fence. Request <br />'i.s in violation of Ordixiance #62-33, Section 1151.04,. <br />fence not to exceed 4' in:height. <br />Mr. Sturgeon asked the Board permission to amend his original request from 48.' to 96' of 6' 'fence. The Board granted this request. Mr. Sturgeon said <br />the purpose of this reqvest for over height fence was for shielding his <br />residential home and property from the Gommercial business places, Krogers <br />arid Sv.per-X Durg. He is immediately adjacent to the rear part of the stores. <br />Stock deliveries, garbage cans,.debris, and other items normally associated <br />with eommercial use are.iri this rear area. It was noted by,the Board that <br />this would amount to a buffer- between 'the eommercial and residential district. <br />Motion was made by Mr..Greene to grant fhe variance for 96' of 6' high privacy <br />fence, seconded .by Mr. Zancashire. Unanimously approved. <br />8. Appellant: Request for variance by Richard.N. Swanson, 5956 Sherwood Dr., <br />North Olmsted to enclose-rear yerd with 5` basket weave fence. <br />Request is'in violation of Ord. #62-33, Section 1151.04,- fence <br />°not to.exceed 4` in height. <br />Present and representing Mr. Swanson, was James Dyson, At_ty. <br />Mr. Dyson described the fence as a basket weave 5' high. Purpose to restrain <br />a large dog owned by Mr. Swanson. Neighbors not objecting to the installation <br />of this fence were Wayne Sauer, Louis Camino, Donald Matthews, and John Stevens.
