CITY OF NORTH 0124STED - BOARD OF ZDNING APPEALS <br />Regular Meetizig held at City Hall --- June 19., 1969 <br />The rneeting wa,s ca]1ed to order at 7:3$ P.M. by c?irman Jolari RobQrt-s. <br />Those Present; Mrse Eian, Nissrs. Greene, Roberts, Davis <br />Alsa Present: Mre Gundy, Build3.ng Commissioner <br />The rniilutes of the 5/28/69 meeting were approved as written. <br />1. Appellarit: Benedetto J, Polliee' 26102 Defoe Drive. Request to erect 4 sections of <br />61 fence and 2 sections of 51 fence around patio area. Request is i.xi <br />violation ef €lydinance #62-33, Sectiom 1151.04, fence shall not exceed <br />41 in 11eight. <br />Present: Mrs. Pollice <br />Mrs. Pollice explaixied that they live on a cul-de-sac street and that the lligher sections <br />of fence would step down to 4t sect3.ons whi.ch ioUdcomple'?ely encloSe the yard. The <br />sections in question would provide privacy .f.mr. the pativ and pvol area of the yard. Her <br />neibhbors have no objections to the .fence and there is A vacant field to the xear of the <br />property wlaich will eventually be a park. Mr. Greene moved ta gra.nt a 2' variance irl <br />height for 321 of fence and a Is variance in height for 16, of fence. Mrs. Eian seconded <br />the motion. Unanimously passed. <br />2. Appellant: John J. Kunkel, 3857 BristcaZ La.ne. Request to erect 5' fence around patio. <br />Request is in violation of Qrdinance #62-33p Sectiott 1151.04, fenee not to <br />exceed 41 in heioht. <br />Present: Mr. Kunkel <br />Mr. Kunkel explained that his honie is on the corner Iot of Bristol Lane and Chapel Hill <br />Drive. The backyard is completely exposecl to traffic on Canterbury. Road and Chapel Hi7.l <br />Drive and there is ao privacy whatsoever. There is on1y a small section of the fence <br />tha.t would be in violation since it was deter,aiined that this was a windbreak rather than <br />a fence which allows the additional height sQ Imng as it is located 151 from the property <br />line. Approximately 11 sections (I2" )would be 13" 8" f'='om the prvperty Iine instead o£ <br />the recauired 151. Mrs. Eian moved ta grant a variance for approx3.;nately 12 -$1 sections <br />of 5' fence. Mr. Greene secondsd the motion. IInanimously passed. <br />3. Appellant; James R. Speck9 24931 Doe Dri've. Request to erect detached garage 31 from <br />property Iine. Request is in v.io.Iation of Urdinance #62-33, Section 1151.04 <br />which requires that a detache3 garage be a minimum vf 58 fron any Iot Iine. <br />Present: . Mr.. Speck., Mrs Ada.ms <br />Mr. Speck statedmthat there is a swale at the rear of his lot so that garage cannot be <br />moved Furthur back. It would be a severe liardship tm get into.the secomd seetion of garage <br />if it is locatecl 51 from the property line. Mr. Adamg, hi.s next deor neighbor, stated that <br />he has no obj eetion to the garage being 31 from hi-s property Iine. It was poixlted out <br />t'mat there are many siinilar situations in thia Meighbmrhood. Mr. Greene moved to grant a <br />variance o.f 21. Mr. Davis seconded the motion. Unanimously passedv <br />4. Appellant: Robert A. Kvvacs, 24476 Noreen Drive. Request to erect a 41 fence on a <br />corner lot, -Request is in violation of Ordinance r?`r62-33' Section 1151.04, <br />fence a._long street line may not exceed 30t' in height. <br />Present: Mr. Kovacs
