CITY OF IVORTH OLMSTED - BUARD OF ZONING APPEAI,S <br />?. - <br />Regular Meeting held at City Ha.II ----- May 7, 1969 <br />The meeting was called to order at 7:40 P.M. by Ch$ir;nan John Raberts. <br />Those Present: P+Irs. Eian, Mssrse Greene, Roberta, LancAShire, Forcellini <br />Also Preaent: Mr. Gundy9 Building Commissioner <br />The minutes of the 4/24/69 meeting were approved as written. <br />l. Appellant: Don G. McDaniels, 3791. Co].umbia Road. - Continuation of request for <br />variance tp erect a detached gara,ge 31 from Pxisting dwelling. Request <br />is in violation of Ordinance #62-339 Section 1151.04 which requires a <br />miiaimum distance of 20t between dwelling and detached garage. <br />Present: Mr. Searman representing Mr. McDaniels <br />Mr. Searinan presented estimates of cost for building both at'tached and detached garages. <br />An attached garage would run $3000 raore because there is a2ready concrete arld a driveway <br />in the location where a. detached garage ?*uld be built. Mr. searman stated that he aZso <br />.ieZt that ann attached garage would detract £roin the appearance of the neighborhood since <br />it would cut into the 501 setback maintained by the adjacent honsese It wa.s discovered <br />that additional variancea would be necessary for the detachedgarage since it would.also <br />be too ctose to buildings on both adjoining lots. Mr. Sea.rman statecl-that_neither of <br />the nezghbors,invo3ved had-any obj-ection. Mre Greene-suggested the possibility of <br />attaching agarage in the location where a detached garage would .be constructed by means <br />of a breezewayo This plan would mean that fewer.variances would b.e req_uirecl. Mrs. Eian <br />moved to continue the case to the next mr;etirg in the interest of reducing the ntu?lber <br />of variances; seconded by LMr.. Greene and passec?. <br />2. Appellant: Sinclair Oil Co., SE corner of Lorain Road and Park Ridge Drive. <br />CQntinuation of request to conduct business activity witliin the setback <br />area (gasbli.ne pumpa). Request is in violation of Ordinance #62-33, <br />Seetion 1174.02 which nrohibits any business activity wi.thin the setback <br />area. <br />Present: Mr. Scanlon and Mr. Lambros, legal council for Sinclair OiI Co., Mr. :G3asgow <br />and Mr. Yoder from Sinclair Oil Cb., various residents of Park Ridge S.ibdiv9.sion <br />Mr. Roberts called on the Law Director for his interpretation.of whether or.not a <br />variance wa.s called for because of Seetion -1173.02 (H72 _tahich statES tha.t. no f.iel filling <br />appliance aha11 be er.ected within 15' of .anv_street Iine..Mr..Kitchen-stated.that no <br />variance would be required since pttmps are permitted 151 from street Iine according to <br />the codea The request for variance was.dxopped..and mo action is necessary by the Board <br />of Zoning Appeals based on the ruling of the Law Director. Mr. Gundy pointed out, <br />however, that the proposed service station vou7:d be within 5001 of a public building <br />(Post Office) and that a variance would be required on this matter. Mr. Kitchen stated <br />that new notifications would have to be sent out before this matter couZd be considered. <br />This case will be heard at the next meeting. <br />3. Appellant: Detroit Aut,o jdash9 25715 Lorain Road. Continuation of request to erect <br />pole sign in excess of permi.tted squa,re foota.ge. Request is in violation <br />of Ordina.nce #62-33, Sectiori 1225.02. <br />Present: Mr. Stern, owner of Auto Zdash; Mr. Wagner of Wagner Sign Co.., Mr. Wolf, Mre Cooney <br />Mr. Stern stated that they have tried to comply with all requests inade regarding problems <br />at the Auto IJasM. Slag h?.?.s been poured on dri4eway and along side of building to stop <br />flow of water, a dra.in is presently being installed to totall:y alleviate the problem, <br />garbage is now being kept inside the building and not outsideg etc. Mr. Wolf and Mr.
