BOARD 0F 70NING APPFALS - 5/7/69 - Page 3 <br /> <br />Mr. Feclor, attorney reprPSenti.ng .Mr. Baratko, pr.esented plans for an add.ition to <br />be made to .a non-conrorming building located at 2381+5 Lorain Road. He expZa.ined <br />th?t his elient..wishes to operate a first-class restauraast si.milar to the one noW <br />in operation on Detroit Road and to be known as Elzonats Red Carpet Inn. The <br />buiIding is non-conforming in that it is set back 371 instead of the required 501. <br />Their pIan is to add to the width of the pr.esent builciing since they feel that to <br />move t,he new addition back 504 would detract from the appearance since-it would not <br />be even wi.th the existing front. They maintain that this wc>uId result in an undesirable <br />121 area that would.be a cateh-a11 for debris9 papers, etc. blowing down the street. <br />P5.irthurc?ore, Mr. Fedor mainta.ins that the acldition would conform to the height,,coverage <br />a.n6 use reguirements and that there is no mention of setback in the codeo He feels <br />that absence of the word setback in the ordinance means that setback is.riot a. require- <br />ment unaer Section 1231.02 (B) in regards to granting of a special permi.t for an <br />acldition to a nonconforming building. The addition would eonfonm in all other respects. <br />Mr. McIntyre, representing Mr. ganzes, stated that he recozarneMds that a permit be <br />granted. Mro ICaserrnan :and .a r.epresentatiue of the North 01.msted Masonic Temple both <br />stated that they felt Mro Baratko-should be allowed to proceed. Mr. Greene moved to <br />continue the case so that the Law Director coulel be consulted to determine whether or <br />not it was within the power..of tneJBoard of 7oning. Appeals to grant a special pernit <br />in this case. Mr-so Eia.n seconded the motion. Unani:nously passec?e <br />8. Rer1uest is in violation oi Ord. <br />#62-33, Section 1225.02. <br />Present: Mr. Biskey <br />Mr. Biskey, District M3nager of Payless _Uervice Stations, explained that the present <br />signs a.re extremely Iar•ge (both are 481 X 261 in size) arid that they wish to replace <br />these two signs with two smaller oneN placed forward about 351 in £ront of the present <br />location. the new signs woulcl be $,3p X 261 in size vhich ti=ould. ra.ean that the total <br />square footzge wauld be red.uced by more- than. ha1f bu-t -vould stil2 be in excess of the <br />size permitted by approximately 100 squaxe.feet. Mr. Forcellini seconded the rnotion.
