d,- <br />J <br />' Page 2 Zoning Board of Appeals Minutes Jan. 7,1970 <br />NIr, Lancashire moved because of the unknown date when State will acquire <br />the property,which wi11 not cause a hardship to legally locate in rear of <br />property that request for variance be deniede Mr. Davis seconded the motionm <br />Motion passed by a vote of 4 to 1 with Mr. Greene abstaining. <br />2. Appellant: Fotomat Corpm Continuation of request for variance on <br />number of parking spaces required for proposed Fotomat to <br />be located on N.W. corner of Lorain and Walter Roads (Corner <br />of Buckeye Lanes parking 1ot. Request is in violation of <br />Ordinance #62-33, Section 1212.02 which states minimum parking <br />requirements. <br />This case was continued for purpose of getting Law Directors' <br />ruling as to whether Board has any authority in the matter. <br />Present: Mr. J. Greenwood for Fotomat Corp. <br />Chairman John Roberts stated Frank Lord of the Law Directors Office ruled <br />that the Board cannot rule on variance of a non-conforming land use, therefore, <br />this case cannot be heard by the Zoning Board of Appeals. <br />3. Appellant: Halleen Ford Coa Request for variance to permit the paving <br />and use as a new car storage and parking area, Perm. Parcel <br />#232-8-5, property determined to be zoned single residential, <br />in conjunction with automobile agency. Request is in <br />violation of Ord. #62-33, Section 1151, Use Restrictions <br />Residence Districts. <br />Present: John Ke11y, Attorney, & Mro Halleen <br />' <br />Mr. Ke11y stated B.B. & Go. Realty are rightful owners of land where presently <br />Halleen Ford Agency is located, also parcel adjacent directly North of Lorain <br />Road property on East Park Driveo Mra Kelly then read letter sent to Mr. <br />Gundy, Building Comm. Dec. 1,1969 requesting variance from Zoning Board for <br />Perm. Parcel #232-8-5 known as 5279 East Park Drive. <br />Mre Ke11y stated Mr. Halleen appeared before the Zoning Board April 1968 <br />prior to opening the Ford Agency, which originally was an existing building <br />in a state of disrepair. At that time the request was for variances for <br />signs and set backse Mro Halleen also entered into purchase agreement for <br />property immediately adjacent to Lorain Road property to the North, at which <br />time this parcel was presented by Owner and Real Estate as commercial zoned <br />property, and stated that on the Zoning Map you wi11 find this property when <br />scaled is within Commercial Zoned District, so Mr. Halleen in good faith <br />bought this parcel to use in conjunction with car agencya The principal <br />parcel is approximately 32.acres, not large enough for the new car agency, <br />which has approximately 200 cars and 53 eniployees who need parking space, <br />also customers need parking space. Purpose of additional parcel is for new <br />car inventory storage areaa Mro Halleen has made large investment under the <br />assumption he could use a11 area which would make for a better traffic pattern <br />and cut down congestion in.surrounding areao <br />Chairman Roberts requested Mra Ke11y indicate on plan map the location of parcel <br />for which variance was requested. Mre Roberts noted that in scaling original <br />Zone Map that the first Parcel on East Park was in 500' Commercial Zone.
