? <br />?.. <br />. <br />Page 3 Zoning Board of Appeals Minutes Jan. 7,1970 <br />Mayor Ralph Christman stated that in comparing the original Zoning Map with <br />the original property line map of the same date, that zoning only includes <br />the corner parcel and not first lot on East Park Drive. Error is in scaling <br />on map. Was intent of Coun.cil when zoning took place to zone to rear of <br />corner parcel, if came before 500' it stopped at rear of corner parcel. <br />Actual error in maps. Permission to use parcel can only be done by request- <br />ing rezoning or action of Councils <br />Mr. Ke11y took issue, stating this was how map was published, under the Zoning <br />Ordinance, the Zoning Board can grant this if zoning map is in error. <br />Mayor stated Court cannot rezone, and Zoning Board cannot rezone either. <br />Mr. Roberts said letter of Law Director indicated, even though map was scaled <br />out at 500' the intent is what counts, not what shows on paper. <br />Mr. Roberts said this Board cannot act on Zoning of this property. <br />Mayor stated Mr. Halleen made specific request to use as Commercial Property. <br />Don't feel the City can grant request to use as Commercial property. <br />Mr. Halleen can only come in for rezoning. <br />Mro Ke11y requested date of Law Director's Ietter, Chairman Roberts stated <br />it was May 8,1968. <br />Mrs. Eian moved request be denied, due to the fact that the Soard feels <br />request constitutes rezoning, because zoning map (official Linen) shows <br />corner lot only zoned commercial. Seconded by Mr. Davis. Unanimously passed. <br />4. Appellant: Pure Oi1 Co. Request for variance to permit erection of <br />canopy over present pump island at Pure Oi1 Station, <br />25290.Lorain Rd,,Request is in violation of Zona Ord. <br />#62-33 Section 1174.02 - Set back regulations in Retail <br />Business District. <br />Present: Jack A. Rood <br />Councilman Virginia Hodgins <br />Mr. Rood indicated on plat proposed location of canopy over existing pump <br />island and presented photos of similar canopies at other stations. Because <br />of way property was squared off in conjunction with locating of new highway <br />252 and because State rule limits station to only two entrances, one on <br />Lorain Road and the Medical Building entrance, location of pump island from <br />sales area creates a problem for customera Canopy wi11 a11ow dealer to <br />have credit card desk at the pump islandm <br />Councilman Virginia Hodgins stated she remembered that the Medical Building <br />sold property to Pure Oi1 Co. prior to building, original transaction gave <br />Oi1 Co. first chance to set up Iocation of gas pumps. <br />Mrs. Eian questioned whether safety factor any problem. Mr. Rood stated <br />Canopy would be up 12', see no problem, does not create traffic problem. <br />Mrs. Hodgins questioned height of lights from street. Mr. Rood said lights <br />would not be objectionable. Canopy would serve as built in desk section <br />for charge-a-plate service. <br />Mr. Greene stated he can see no hardship, can have a charge a plate section <br />without canopy, attendant must make change for cash customers from station <br />anyway and distance to station entrance has been no problem for past two <br />years since station was built, therefore on this basis moved variance request <br />be denied. Seconded by Mr. Davis, Unanimously passed.
