? <br />BOARD OF ZONING APPEALS - 12/1/71 - Page 2 <br />AZl witnesses were sworn in. Mr. Gates presented plans. Mr. Rol1 asked if both <br />homes wou].d be the same. He was told they were, Mr. Tubbs asked why Mr. Gates <br />did not conform to the code. Mr. Gates stated that 3.t would be too costly. <br />Mr. Tubbs made a motion to grant a 201 var3.ance on S/L 201 seconded by Mrs. Eian' <br />and unanimously passedo <br />5, AppeZlanto Hennie Homes - Request to erect a dwelling at 3915 Wood Park <br />Lane with a]..5' side yard variance (1133.13) .Request is in va.olation <br />of Ord. #62-33, Section ii59.029 which requires a minirnum setback on a <br />corner 1ot of 251. <br />Present: Mr. Richard Puzitello. <br />Mr. Puz3.te11.o was sworn in. He presented a p7.cture of the proposed home. A <br />discussion was heldo Mr. Roberts asked how much of an overhang 3.s there? Mr. <br />P uzitello said a.t was a foot. Mrs. Eian moved to grant a 1,5' side yard variance; <br />seconded by Mr. Tubbs and unanimously granted. <br />6. Appellants Bauer Development - Request for varxance (1133.13) to erect <br />dwelling at 3903 Canterbury Rd. with a 103090' setbacko ftequest is in <br />violation of Ord. #62-33, Section 1159e01' which xequires a 501 front <br />yard. <br />Presen-t: iMro John J. Alan, Mr. John Then, Mr, Henry Rienhard, and Mr. F. Lavoie. <br />Al1 witnesses were sz-iorn 3.n. Mre Roberts read a 1etter from Mr0 A1an, stating <br />that because of the number of trees on this 1ot, he would like to set the hotzse <br />back far enough away from the trees, Mr. Then and Mr. Reinhard had no objection. <br />Mr. Lavoie had an ohjection to the setback. He said that it puts the houses back <br />further and further. Mro Roberts pointed out that by lining the houses up the <br />way they as°e9 on an angle., they are making it 1.ook much better. Mr. Tubbs moved <br />to grant a 40' front yard var3.ance or up to 1101 setback. It was seconded by <br />Nirs. Eian and unanimously passed. <br />7, Appellant: HiZde Ludwig and Chester E. Gordon, Trustee, - Request for <br />heara.ng of Appeal on rejectyon of appl.i.cat3.on for retail store by <br />D. H. Ra,nsbury, Officer and Assistant Cyty Engineer (letter dated <br />October 5, 1971 proposed 7-11 Store in viol.ation of Section 1141.04 <br />Ordinance #62-339 which requix°es Retail. Business Zoning have at least <br />50 feet of frontage on Lox°ain Road or Brookpark Rdo) as requi.red by <br />Ordinance #62-33, Section 1133.08. <br />Present: Mrso Hilde Ludwig, Chester E. Gordon9 and Mr. Walter Masono <br />Al1 witnesses were sworn in. Mr. Roberts read the letter that was written by <br />Dave Ransbury, to the architect, and also a letter from Clague Road Congregational <br />Chureh. The CYiurch is very concerned about the traffic problem should this <br />variance be granted9 additional traffic introduced to this area would further <br />accent th3.s problemo Nr. Gordon stated that this 1ot has a 2001 frontage on <br />Lorain Road and is a singl.e parcel, therefore they have the required frontage. <br />At one time Mrs. Ludwig asked that this parcel be subdivided into two parcels <br />and was tvrned down by the Planning Commission. She has 1.eased the front of <br />this parcel, which is 14019 to Sun Oi1 Co. and the back of the parcel, which is <br />901 , to the Southland Corp. for the 7-11 Store,
