<br />BOARD OF ZONING APPEALS - 12/1/71 - Page 3 <br />Mr. Gordon stated that the Planning Commission had turned down this request because <br />of a safety factor in regard to the traffi.c f1ow. Mr. Mason, 3639 Clague Rd., said <br />that he can't get out af his driveway because of the heavy traffice Mr. Ransbury <br />presented plans. Mrs. Eian asked if Sun Oi1 would give the 7-11 Store a right <br />of way to drive through their property? Mro Gordon stated that Sun Oi1, has turned <br />down the i.dea of an easement on this property. Mrs. Ludwig stated that 90 per cent <br />of the 7-11 Storeos business would be between 6:30 and 7:00 and on holidaysm <br />Therefore there would be about a 1 per cent 3.ncrease 3.n the traffic, Mr0 Ma.son <br />said that even l per cent is adding to the burden. Mr. Ma.son felt that the space <br />in the back should be treated as a separate unit from Sun Oi1 Co. Mro Roberts <br />asked how long the lease 3.s for Sun 0i1? He was told it f.s twenty years. Mr. <br />Tubbs asked if Mrs. Ludwig had been advised of this when the lease was si.gned? <br />Mrs. Ludwig said she had9 but did not have an attorney at the timee Mra Mason <br />said that we canno-t al1ow one item like this to ruin the commun3.ty. Mr. Tubbs <br />stated that the Board should take this under advisement and have a consultation <br />with the I,aw Director, as far as what is to be considered legal in regard to <br />subdivision of this 1ot. He would also like to have the Safety Director examine <br />this. NIrs. Eian asked if Mrs. Ludwig and Mr. Gordon could talk to Thom McAm; to <br />see if they would give them an easement. Mr. Tubbs moved to continue this case <br />next month in order to get the advice of our Law D3.rector. Mr. Tubbs would also <br />like to see a traffic count or study made at peak periods and on Sundays. It <br />was seconded by Mrs. Ei.an and unanimously passed to be continued. <br />8m Appellant: Gene F1ott, 25984 Lorain.Rd. - Request for a special permit <br />for renovation of exterior and partial interi.or of the exist'ing non- <br />conforming building?,, Permit requested as per Ord. #62-33, Section i231m02. <br />P resent: Mr. Gene FZott, Mr, Fred Boehme9 Mr. Nick DeIGuidice9 Ntr, Boehmer, council- <br />man. <br />A11 witnesses were sworn ine Mrs De1Gu3.dice, the architect, presented photos and <br />a large drawing, A discussion tiias helda Mr. F,l.ott stated that they are trying to <br />upgrade the place, Mr. Roberts read a 1,etter from Mr. Jatnes Ps°okasy, councilman, <br />who is in favor of this px°oposalo The architect stated that they would like to <br />eliminate the present front door9 which goes directly to the bar and add to the <br />building, therefore making another entrance. Mr. Boehmer stated that he has talked <br />to other counciltnen in regard to this and theg a1.l are in favor of this as it <br />would upgr-ade the building and improve the citya Mrso Eian moved to grant a <br />special percnit for rennovation and addition of existi.ng building.
