BOAR.D OF ZONING APPEALS -(9/22/71) - Page 2 <br />-Mr. Wooten stated that Mr. Minderhout was never notified in any manner that this <br />property was being changed from commercial to residential, therefore the ordinance <br />is void. <br />??4&r. Scott, 5656 McKenzie Rd,, wanted to know if Lawson's doesn't go through with the <br />dea1, would there be another hot dog stand? <br />• Mrs. Pat DePaola, 5471 McKenzie, stated that McKenzie is a very narrow road and a <br />Lawson store would intensify this tremendously. There are enough stores within <br />walking distance. <br />Mr. Vince DePaola, 5471 McKenzie, questioned the fact that the 1ot was zoned as <br />commercial, as it does not have a 50' frontage. He stated there were enough stores <br />in the area. He also stated that McKenzie Road is only 18' wide and with Lawson's <br />using full-sized semi trucks, there would be a danger to the children in that area. <br />Mr. Everett, 5564 McKenzie, asked the width of the driveway of the Lawson's Store, <br />He was told it was 30'. Mr. Everett stated that he also thought there would be a <br />great danger to the children, <br />Mr. Speedling appeared on behalf of the residents of McKenzie. He said that he <br />thought there was a safety hazard involved. <br />Mrs. Simonyi, 5525 McKenzie, questioned the fact that there is not a 50' frontage <br />on Zorain. <br />Mr, Eu11er, 5701 McKenzie, stated that McKenzie is narrow and overcrowded. He thinks <br />it would be a hazard to the chi7dren, or anyone else trying to cross. He said there <br />are not enough policemen to patrol that area. <br />?Kriechbaum, 5679 McKenzie, stated that she is very much opposed to anything of <br />this sort. There are too many children that would be endangered. <br />Mr. Fink, 5565 McKenzie, was in agreement. He could see no vaZue of a store in that <br />area. <br />Mr. Linton, 5493 McKenzie, wanted to know how this would affect the property taxes? <br />Mr. Minderhout stated that two lots could be cut out of this one 1ot. Approximating <br />that it would cost $450s00 in taxes for each 1ot, this would be a total of $900.00 <br />a year. With a Lawson store, the taxes wou1d be over $1,600e00 a:year. This might <br />lower the homeoraners' taxes approximately tVao or three cents. <br />Mrs. Berger, 5541 McKenzie, was in agreement with her neighbors. She felt this <br />would.ruin McKenzie road. Mrs. Husak, 5690 McKenzie, stated that there is not a place for a Lawson Store on <br />a residential street. <br />Mr. DePaola said that he has enough trouble getting out of his driveway now. <br />? Mr. Tubbs made a motion to deny the variance requested for the Lawson Store, Mrs. <br />Eian seconded the motion, and it was unanimously denied. <br />?f <br />The matter regarding the adoption of the ordinance as mentioned in the application <br />o or the Lawson Store on McKenzie road wi11 be referred to Bruce Kitchen, Law Director, <br />s per Mr. Gundy's request.
