CITY OF NORTH OLMSTED -BOARD OF ZONING APPEALS
Regular Meeting Held at City Hall -July 7,1971
Members Present: Mre Burglund, Mr. Tubbs, Mr. Scheef, Mrs. Eian and
Chairman Roberts
Meeting was called to order at 7:30 P.M.
l. Appellant: Robert E. Almquist, 23248 Stoneybrook Drive, continuation
of a request for variance to erect an addition to existing
dwelling too close to rear lot linee The Secretary read a
letter addressed to The Board from Mr. Robert W. Gomersall,
23228 Stoneybrook Drive in opposition to the request.
Architect Edward Almquist submitted new plans, which now
requires an 18 ft. variance. Pool size reduced and the
rooms rearranged. These plans were compared with the
originals submitted: Mrs. Raymond Karey, 23231 Stoneybrook
Drive inquired as to the adequacy of storm drainage.
Discussion continued and the open area as required by the
Ordinance was deliberated. Mr. Tubbs considered the request
excessive and made a motion to deny, seconded by Mro Scheef.
The hearing continued at this time with alternate plans
submitted which would require a variance of 12'10". This
plan was studied by the Board. Architect Almquist stated
the possibility of a above grade plastic enclosed pool
conforming to code. Mrm Tubbs.withdrew his original
motion, Mr. Scheef withdrew his second. After deliberation,
Mr. Scheef made a motion that the plans submitted requesting
a variance of 12'10" be presented to interested neighbors
by Mr. and Mrs. Almquist and the case to be continued until
the next meeting of the Board, seconded by Mr. Tubbs, motion
was unanimously approved.
2. Appellant: Myron Sawchak, 3955 Shelley Drive, for a patio fence
enclosure on North Side of dwelling. Request is in violation
of Ordinance #62-33 which states that fences extending closer
to the street line than the building line may not exceed 30"
in height. Mr. Sawchak appealed to the Board, asking permiss-
ion to erect a chain link fence to enclose the Patio. He has
two dogs and shrubs would be planted all around the patio,
and the purpose of the higher fence would be to restrain his
two dogs. He then presented pictures of the existing house
and explained that he was on a corner lot. Mrs. Eian moved
to grant a 6" variance, seconded by Mr. Saheef, unanimously
approved by the Board.
3. Appellant: William A. Hall, 5457 Kennedy Ridge, requesting a special
permit to add to a non-conforming dwelling. Request was made
per Ordinance #62-33. Mr. Ha11 said that his house had been
constructed in the 1940s and that the existing front set back
and side set back lines were typical of the neighborhood and in
conformity with Zoning laws of that day. The family and work
room would conform to present day regulations. Discussion
was held by the Board. Mr. Tubbs moved to grant a Special
Permit, seconded by Mr. Scheef and unanimously approved.
