Roll Ca11 <br />The meeting was called to order at 8:02 P.M. by Chairman Donald Ledvina. <br />Those present were Messrso .Ledvina? James Davis' Kurt Richards9 Jo Edward <br />Brewer' James Leonard' Edward Byers. <br />A1so Present: Mrm Ransbury, Assistant to City Engineer; Mr. Gundy' Bui1d3.ng <br />Commissioner; Marge Nader, Secretary. <br />II, Reading and Correction of Minutes <br />Mr. Leonard's name was 1.eft off the minutes of the 12/14/71 meeting in error, <br />Mr. Leonard moved to approve the minutes as corrected; seconded by Mr. <br />RZChards and unanimously approved. <br />III. Building Department Requests <br />(a) Szarkaes - Mr. Gundy presented plans. Mr. Szarka proposes to convert <br />the delicatessen to a restaurant which would seat 95 people. There is <br />an allowance for 67 parking spaces, which is far and above the require- <br />ments. Mr. Leonard asked about the setback. Mr. Gundy said that it is <br />a non-conforming building, but it can be changed as far as occupancya <br />Mr. Leonard said that it looks like the use is actually being changed <br />and he would like a letter from the Law Director. Mr. Leonard moved <br />that this proposal be put into the committee of the whole until we <br />get a letter from the Law Director describing the setback requirements <br />of a non-conforming building; seconded by Mr. Brewer and unanimously <br />approved to hold this. <br />(b) Manor Care Inc. - Mr, Gundy presented planso Mro Gareau and Mr. Ftankin <br />represented Manor Care. Nir. Gareau said that the Zoning Board had <br />granted variances fors canopy, building angle, and permission for 16 <br />parking spaces within the residential area, Mr. Pohlman represented <br />the neighborso He said the neighbors would like a privacy fence, which <br />would be 61 and go along the entire length of the propertya Mrm Baker, <br />of Mildred Avenue' asked about the area in the back, is this not also <br />considered part of the business? What would prevent anyone from going <br />back to the rest of the property? Mre Gareau said that they would <br />agree to. go back to the Zoning Board with a 61 fence bordering the back <br />of the parking area. Mr. Pohlman presented a picture of the fence the <br />neighbors would desire to have. Mr. Ledvina moved that a 6' privacy <br />fence with the discretion of the Building Commissioner and meeting <br />with the neighbors' back to the end of the commercial zone. The <br />petitioners agree to request the Board of Zoning Appeals to grant a <br />variance to put up a b' fence of similar construction immediately <br />adjacent to the variance line. It is further stipulated that there <br />wi11 be no access to the gate; there is to be a service gate used <br />only for maintaining the property; seconded by Tqr^. Brewer and <br />unanimously approved.
