City of North Olmsted BOARD OF ZONING APPEAIS December 53 1973 The meeting was called to order at 7:45 p.me by Chairman Roberts Present: Chairman Roberts, Mrs. Eian.and Mr. Duskey Also present: Mr. Gundy, Building Commissioner, Mrs. Hodgins, Record- ing Secretary and Councilman Speedling. Mr. Roberts announced request of Mrs. Frank H. Moore to be continuede Mr. Roberts announced request of T. H. McMinn to be continued. Mr. Roberts announced request of Alfred & Edyth Wilchek withdrawn. Mr. Roberts stated due to lack of notification of proper parties in- volved request of D. J. Caldwell will not be heard tonight. Continuance of hearing of request of Barney Schwarzer, Pres., Nodern homes and Bldgsy Inc. 21990 Lorain Rd., Fairview Park, Ohio, 44126e Request for variance (62-33 Section 1133•13). Request to build Re- tail Center at Fark Ridge Dr. and Lorain Rd. (28669 Lorain). Hear- ing required on basis of Section 1215001 Ord. 62-33 Mro Roberts had reviewed with Law Director Kitchen the 1133.13 Power of Appeals requirements and verified the case should be before the Board of Zoning Appeals. Mr. Roberts also discussed the case with Safety Directox R. Carna- han who finds the plans are basically the same as those he rejected when this was before Planning Commission and Council BZD Committee. He states the present development would be a safet,y hazard. NIr. Roberts suggests the developers return to the Planning Commis- sion and give full cooperation to a revised plan that will be to the best interest of the safety for our Communit,y. Mr. Roberts asked the Board to deny the variance. Mr. Roberts read letter dated November 21, 1973 from Ray S. Carna- han, Safety Director, stating traffic hazard involved. (Copy of letter attached to these minuteso Mr. Duskey moved to deny request based on safet,y hazard as discussed. Mrs. Eian seconded and motion passed unanimously.
