Zoning Board of Appeals 1-10-73 - 2- <br />is on Schul2 property -- 8.5 inch encroachment of Snowden onto <br />Schulz property. Mr. Schulz again presented petition signed by <br />6 neighbors. N1r. T,ibbs read letter from C. Crabs. Mr. Tubbs had <br />investigated properties in question. The shrubs enhance neighbor- <br />hood; perhaps provides a sound barrier. This is a residential <br />neighborhood. tiJe do not have much control over noise. ZaTe must <br />be considerate of our neighbors, try to aid them in cutting down on <br />problem. Mr. Snowden iaill do all he can to keep noise down here- <br />after. Mr. Scheef moved decision made by 14r. Gundy regarding Grand- <br />father Clause be upheld. Mr. Berglund seconded the motion. Af- <br />firmative vote: Tubbs, Scheef and Berglund. Yir. Roberts abstain- <br />ed. Nlr. Snowden's attorney disagreed with the Board's decision. <br />1. Robert Falkenber , 25014 Arlington Lane. Request for variance <br />1133.13 for special permit to erect tool shed in violation of <br />Ordo 62-33 Section 1133.09. <br />Present: Mr. Falkenberg. UJitness was administered the oath. A <br />description of the tool shed and its location were given. Lot is <br />145 ft. deep and 60 ft. wideo There are some tool sheds already <br />in the neighborhood. Applicant needs more storage space; he had <br />double garage. Mr. Scheef explained the Board's objection, the <br />lots are too small and tool sheds are against ordinances; they can <br />downgrade a neighborhood. Mr. Scheef moved to deny request for <br />special permit. Mr. Berglund seconded and the motion passed. <br />2. I natius J. & reraldine A. Coni ilio, 25820 W. Ranchview Ave. Re- <br />quest for variance 1133.13 . Request for special permit to build <br />addition to non-conforming building at 23790 Lorain Rde Violation <br />of Ord. 62-33 Section 1231.02. <br />Present: Mr. Conigilio, ivlr. Rosenberry, Yx. Redmond, Mrs. Zipp. <br />Witnesses were administered the oath. Proposal is for 25 ft. x <br />30 ft. one story addition to Olmsted Professional Building, the <br />addition to be for an insurance agency. There is county ditch <br />behind. The neighbors mentioned tremendous flooding problem on <br />Gessner Road. Blacktop makes water from medical building, furni- <br />ture store all drain onto Gessner. Where wil.l the Vaater go? Nir. <br />Rosenberry gave easement to city for sewer work and Mr. Conigilio <br />gives permission regularly for city heavy equipment to use his <br />driveway for access to the problem. Mrs. Zipp asked about other <br />non-conforming additions. 4he was told anyone can apply; each <br />case can be considered on its awn meritso Final pl.ans for drain- <br />age of Conigilio property will be considered by the City Engineer. <br />P1r. Roberts moved to grant special permit -vlith request that the <br />City Engineer give special attention to drainage. ivir. Scheef <br />seconded the motion. Affirmative vote:Roberts, Scheef and Tubbs. <br />Negative vote: Berglund. Motion passed. <br />3. Joseph A.
