City, of North 0lmsted <br />oct. 2, 1974 <br />BOARD OF ZONING APPEAL,S <br />Meeting was called to order at 7-0(0ep:m...=Fi?esent: Chr. Hamill, A'Iessrs. Roberts, <br />Tubbs, :T:edvina. Also present: Building Commissioner Gundy, Law Director Gareau; <br />and V. Hodgins, Recording Secretary. <br />Continuance of request of Richard Dvorak, 5658 Dorothy Dr. Request for <br />variance (1133.13)• Request for 2 ft. fence height variancee Violation <br />of Ord. 62-33 Section 1151.04. Also request for sideline variance for <br />fence. Violation of Ord. 62-33 Section 1161.01. <br />Present: Mr. Dvorak. Case was read and witness was administered the <br />oath. Also needed is 10 ft. rear yard variance. Mr. Ledvina <br />moved to grant 2 ft. variance for height of fence on north <br />side of property. Mr. Roberts seconded. Motion passed. <br />Nir. Ledvina moved to grant 10 ft. variance for rear yard. <br />Variance toallow for construction of patio roof cover. Nir. <br />Tubbs seconded and motion passed. <br />Continuance of request of John W. Lechner, 3157 Olmsted Dr. Request <br />for variance (1133.13)o Request for special permission for tool shed. <br />Violation of Ord. 62-33 Section 1151.04. <br />Present: 14r. and Mrs. Lechner. Case and appeal were read. Vditnesses <br />were administered the oath. Relocated shede 365 ft. deep lot. <br />Tool shed is 80 ft. from house; 60 ft. from tool shed to proper- <br />ty line and.shrubbed. N'?r. 'Itiibbs moved to grant special permit <br />for tool shed. Mr. Roberts seconded and motion passed. <br />Continuance of request of Robert Peac,o, 4063 Tennyson Lane. Request for <br />variance (1133-,'13. Request for 2 ft. variance for fence. Violation of <br />ord. 62-33 Section 1151.04. <br />Present> Mr. and Mrs. Peaco. Case and appeal were read. Witnesses were <br />administered the oath. Mr. Ledvina had made site inspection and <br />reported it is wide open area with no trees to minimize effect <br />of fence; it is not desirable in this area. Mr. Peaco suggested <br />alternate plan. Dogs are problem, also privacy. Mr. Ledvina <br />moved to grant 2 ft. height variance for fence to start 6 fta <br />from side line and to run parallel approximately 64 ft from house. <br />Mr. Roberts seconded the motion. Messrs. Ledvina, Roberts and <br />Tubbs voted-aye. Mr. Hamill voted nay. Variance was granted. <br />Continuance of request of Richard G. Hart, 24772 Theresa Lane. Request <br />for variance (1133•13). Request for special permit for tool shed. Vio- <br />lation of Ord. 62-33 Section 1151.04. <br />Present: Mr. and Mrs. Hart. Case and appeal were read. witnesses taere <br />administered the oath. Mre Hart gave reasons of drainage and <br />esthet?cs for present location of tool shed. Mr. Heizmann, next <br />.door, has small lot and Harts' tool shed is close to his property. <br />Moving tool shed to other side of Hart property vou1d locate it <br />farther from Heizmann property. Mr. Ledvina moved for special <br />permit to be granted for tool shed to be located on northeast <br />corner 15 ft. from side line and rear line of appellants' parcel. <br />Nir. Tubbs seconded.
