Nieberding, R. Goode, J.t> <br />Herkthneck. Witnesses were administered the oath. Case was read and <br />it was explained that variance had been granted and had expired. I-480 <br />is close to lots. The desire is to have proposed house lined up with <br />existing houses. Neighbors do not object, they wanted to know type of house. Mr. Duskey moved to approve 15 ft. variance in front setback, as <br />stipulated according to plan and house to be located 20 fts from lot <br />line as indicated on attached sketch. Violation of Ord. 62-33 Section 117h.07 requiring 150 ft. <br />frontage. <br />Present: Mr. Taylor, representing Red Lobster Inns, Mr. Richards, <br />Mr. Lawson of Lawson Sign Co., N'ir. Rezepka, 14r. Beckrest, <br />Mrs. Saringer, Mrs. Zipp and Mrs. Brown. Witnesses were <br />administered the oath. Surveyer and Attorne.y for Red Lob- <br />ster were also administered the Oath. <br />Case was read, Pfirm Taylor gave presentation - General Mills owns <br />Red Lobster Inns which are informal sit dovin sea food restaurants. <br />Pictures of building and sign were shown. Drawing shows five acre <br />tract with 307 ft. frontage (Sub lots 1& 2). Building is to be lo- <br />cated on Sub lot la There are no plans for development of Sub lot <br />2. Sub lot 1 is planned with 168 ft. frontage. Red Lobster re- <br />quires the additional frontage for its restaurant for safety and con- <br />venience of its customers. The attorney said it is totally economical- <br />ly unfeasible for Red Lobster to purchase the full property. This <br />leaves the remaining lot of 139 ft. frontage not in conforrnity. Pur- <br />chase agreement has been signed for Sub lot l. Discussion ensued <br />regarding changing of plans, moving building back, a common drive <br />between the t-v.lo lots, or other alternate plans. Mr. Ledvina moved <br />to reject plan as presented, iti1r. Tubbs seconded and motion to re- <br />ject passed with Messrss Hamill, Duskey, Tubbs and Zedvina voting <br />aye while 14r.
