BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF AUGUST 2, 2012 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:00 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Michael Raig, Maureen Diver, Laura Bellido, Alfi•edo Lopez <br />Staff: Law Director Michael Gareau, Jr., Planning & Development Director Kimberly Wenger, <br />Assistant Building Commissioner James McReynolds, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Lopez moved, seconded by Ms. Bellido, to approve the July 5, 2012 minutes, which passed <br />5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />David Challcwater; 5122 Andrus Avenue <br />Proposal consists of a pool. The following variance is requested: <br />1. A 129 square foot variance for pool exceeding rear yard coverage, code allows 545 sq ft, <br />applicant shows 674 sq ft, section 1135.02(d)(3). <br />Mr. Challcwater was administered the oath. He said the temporary pool which is erected in the <br />driveway doesn't fit the small baclcyard even if the large shade tree is removed. He would like to <br />lceep the pool in the driveway each year in the summer months and asked if he would have to <br />return each year for a variance. Mr. McReynolds said no matter where the pool was installed on <br />the property it would exceed lot coverage. Board members asked if pools were permitted to be <br />in installed on a driveway in the front yard. Mr. McReynolds said there are no requirements <br />which prohibit or limit pool placement. He advised the applicant the electrical connection to the <br />pool was required to meet code and would need to be inspected. Mr. Gareau advised that in <br />hearing testimony it appeared there could be a question whether or not the matter should be <br />addressed as the applicant has stated the pool is a temporary structure. The board was aslced to <br />table the matter until a deterinination is made if a variance was required. <br />Mr. Raig moved, seconded by Mr. Lopez, to table the request of David Chalkwater of 5122 <br />Andrus Ave until the need for a variance is determined, which passed 5-0. <br />Randell Maximovich; 6496 BrilZhton Drive <br />Proposal consists of a shed. The following variance is requested: <br />1. A 120 square foot variance for a shed larger then code allows, code permits 120 sq ft, <br />applicant shows 240 sq ft, section 1135.02(d)(1). <br />Mr. Maximovich was administered the oath. He said he removed the existing shed as it was <br />dilapidated. He would lilce to install a new shed in the same location however it would be•larger <br />to accommodate yard equipment and provide additional storage. He is trying to eliminate
