BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF JULY 5, 2012 <br />ROLL CALL <br />Ms. Rudolph called tlze meeting to order at 7:05p.m. in Council Chambers. <br />Present: Jennifer Rudolph, Michael Raig, Maureen Diver, Laura Bellido, Alfredo Lopez <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner James <br />McReynolds, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Raig moved, seconded by Mr. Lopez, to approve the May 31, 2012 minutes, which passed <br />5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />Robert Vilevac; 26008 Byron Drive <br />Proposal consists of a fence. The following variances are requested: <br />1. A variance for a 5 foot fence beyond front building line; code permits a fence no greater than <br />30 inches in height and 50% open, applicant shows 5 feet in height and less than 50% open, <br />Section 1135.02(f)(1). <br />BZA tabled 05/31/12 at applicant's request. <br />Sandra Vilevac, the owner's daughter; William and Stacy Russell, and Richard Travis were <br />sworn in. Ms. Vilevac said the height of the fence was decreased to 5 feet and the fence style <br />changed to a shadow box. The shadow box fence will contain their dogs and provide privacy. <br />Ms. Russell objected to a fence along her front side yard saying a fence will create a safety <br />hazard for their vehicles and will lower their property value. Mr. Russell suggested installing a 4 <br />foot chain link fence or perhaps angling the fence and increasing the distance from the sidewallc. <br />A petition signed by neighbors was submitted requesting the variance be denied. Mr. Travis said <br />installing a fence will change the character of the neighborhood. Ms. Vilevac said more than <br />half the corner lots in the development have solid fences so theirs would not change the character <br />of the neighborhood and the fence only extends two feet past their home so vehicular traffic is <br />not affected. Mr. McReynolds said the revised plan shows the fence lower however extended <br />fiirther towards the sidewalk. He prefers the fence placed in line with the edge of the home <br />which would allow the existing landscaping to buffer the view of the fence. Ms. Diver said <br />although the fence was lowered to 5 feet she would prefer the fence be no more then 4 feet in <br />height in the setback area and tapered upward to 6 feet in the allowable area. Mr. Lopez asked if <br />the area outside the fence would be landscaped to soften the appearance of the fence and Ms. <br />Vilevac said no. Mr. Lopez said the fence should be no higher then 4 feet to ensure the <br />neighbors line of site is not impeded. Mr. Raig said the applicant's home is within the <br />neighbor's front setbaclc and the fence will be in line with the home so visibility is not affected. <br />Mr. Lopez moved, seconded by Ms. Rudolph, to grant Robert Vilevac of 26008 Byron <br />Drive a variance for a 5 foot fence beyond front building line; code permits a fence no
