The following variance is requested: <br />1. A variance for a 6 foot privacy fence beyond front building line of abutting property, code <br />permits a fence no greater than 30 inches in height and 50% open applicant shows a 6' <br />privacy fence, section 1135.02 (f)(1). <br />Duane Limpert, Mat McMillan of Budget One Fence and Glen Barton were sworn in. Mr. <br />Limpert said he would lilce to install a 6 foot white vinyl privacy fence within a 50 foot section <br />which is not allowed by code. He presented photos which showed both the proposed location of <br />the fence and that which would ineet code. More than half his home is within the neighbor's <br />front setback. A letter from abutting neighbors was submitted which stated they had no <br />objections to the variance. Mr. Barton said he would like to see the fence approved. The corner <br />lot it is visible including things stored outdoors, the fence will provide the buffering and privacy <br />the owner needs. Mr. McMillan said his client's neighbors have no objections and the fence will <br />enhance the character of the neighborhood. Mr. Lopez said a shadow box fence would help <br />soften the appearance of the fence. Mr. Raig said the garage which is also within the required <br />setbaclc is more intitiisive then the proposed fence which cleans the appearance of the side yard. <br />Mr. Raig moved, seconded by Mr. Lopez, to grant Duane Limpert of 3186 Twin Circle a <br />varaance for a 6 foot privacy fence beyond front building line of abutting property, code <br />permits a fence no greater than 30 inches in height and 50% open applicant shows a 6' <br />privacy fence, section 1135.02 (f)(1). Roll call: Rudolph, Raig, Bellido -yes, Lopez, Diver - <br />no, motion passed 3-2. <br />Denise Queen c& Julie Brown; 24040 Noreen I?rive <br />Proposal consists of a fence. The following variance is required: <br />1. A variance for a 6 foot privacy fence located in required side yard setback on a corner lot, <br />code permits a fence no greater than 30 inches in height and 50% open, applicant shows 6 ft <br />privacy fence, section 1135.02 (fl(2). <br />Note: BZA granted a variance for a 4 ft chain link fence on 5/1974. <br />Julie Brown was sworn in. Ms Brown said the existing chain linlc fence is dilapidated and needs <br />to be replaced. Their home is at the corner of Noreen and Hawkins Drive which is a <br />thoroughfare to Clague Park. There is a tremendous amount of foot traffic along their side yard <br />which is fully exposed. While she understands a privacy fence will not keep their dogs from <br />sensing foot traffic it will keep pedestrians from tormenting their dogs and give them privacy. <br />The fence will enhance the appearance of the area and will match the white trim of the home. <br />Mr. McReynolds said there are no vehicle safety concerns as there is no abutting driveway. Ms. <br />Diver said the condition of the chain linlc fence warrants it being replaced. There are no <br />driveways that are adversely affected by the fence and installing the fence allows the owners the <br />opportunity to have privacy and enjoy their baclcyard. Mr. Raig said the natural vegetation in the <br />area is much more intrusive then the proposed fence and due to the amount of foot traffic a solid <br />fence is needed for privacy. <br />2
