Mr. O'Malley reviewed his research of laws pertaining to indoor firing <br />ranges including federal, state and local laws pertaining to noise levels and hours of operation, <br />noting that State law would supersede local laws. Mr. Mahoney asked if there was a proposal for <br />such a range and Ms. Wenger said there had been no official submittal however Dale Schmidt <br />indicated interest in such a facility in the Industrial Parlc. Mr. Malone asked if such facilities <br />would prohibit the sales of firearms. Mr. O'Malley reviewed that state and federal law would <br />always supersede local laws. Mr. Bohlmann asked if the ordinance address ventilation of such a <br />facility. Mr. O'Malley said state building requirements will have to be met. Board members <br />aslced if firearms would be leased or sold at such facilities and whether or not children under 18 <br />years of age would be allowed. Mr. O'Malley reviewed things which would be governed by <br />state regulations. Ms. Nader asked how the used shells would be disposed. <br />Mr. Schmidt discussed research he conducted pertaining to building such a facility. Ms. <br />Meredith aslced if firearms and bullets would be sold at such a facility and Mr. Schmidt said yes. <br />State and federal laws govern what types of guns can be sold or rented at ranges. There are also <br />regulations pertaining to ventilation systems, wall thickness, bullet removal and noise levels. <br />Patrons are not allowed to use self paclced bullets at indoor ranges therefore bullets can be <br />purchased and or guns rented for use at the facility. It is mandatory that all patrons wear ear and <br />eye protection in such a facility therefore those items are also sold. He noted federal laws also <br />govern the reselling of firearms. Board members felt the proposed ordinance needed to address <br />retail sales. Mr. Mahoney asked what type of clientele the range would draw. Mr. Schtnidt said <br />law enforceinent or anyone wishing to be licensed to carry a concealed gun. <br />Ms. Meredith moved, seconded by Mr. Bohlmann, to table consideration of the Ordinance <br />until the January 9, 2013 meeting, which passed 6-0. <br />ADJOURNMENT <br />Ms. Wenger thanlced Ms. Meredith for her professionalism and years of service on the Plaiuiing <br />and Desigri Cominission.
