Donna Rote
4om: John Lasko • ; _ . _---
;ent: Monday, November 04, 2013 c.19 Pivi -
To: Donna Rote
Subject: BZA -- CM513-376: Jennifer Janak; 27751 Blossom
Dear Ms. Rote:
In your capacity as Clerk of Commissions, please accept this email on behalf of Jennifer Rudolph,
Chair, in lieu of a personal appearance at tonight's meeting of the Board of Zoning
Appeals. Unfortunately, a last minute business matter now prevents me from attending that meeting.
For the reasons briefly set forth below, we respectfully request than none of the requested variances
be approved.
While my wife's and my property at 27834 Sanders Lane does not abut the subject property, the
building in question is plainly and ostensibly visible not only because of the "sight lines" through the
adjoining back yards of the properties on the south side of Blossom and the north side of Sanders but
also its relative proximity to our property. An appropriate analogy might be the appearance either of
the Empire State Building within the skyline of midtown Manhattan or the water tower within the
skyline of North Olmsted.
I+ is readily apparent from the nature of the four (4) variances requested by the Applicant that the
ailding is not a"shed" for use in a suburban/residential area. Instead, it actually is a"barn" for use in
a country/rural area. Further, the nature of the requested variances also plainly indicates that the size
of the building effectively amounts to a second "home" on the lot which, therefore, requires a
masonry/cement foundation and drainage (gutters and downspouts).
All of us are charged with the duty to know the law. Ignorance of the law is not a defense. The
Applicant either knew or should have known that the structure did not and would not "fit" within the
parameters of the Code. Nevertheless, the Applicant affirmatively chose to proceed with the
construction of the building at its own peril and risk.
For the reasons stated above, we respectFully request that none of the requested variances be
granted.
Respectfully submitted,
John J. Lasko, Jr.
27834 Sanders Lane
North Olmsted. Ohio 44070
