_, 'p.. ,, <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />SPECIAL MEETING MINUTES OF OCTOBER 21, 2013 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:05 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Maureen Diver, Laura Bellido, Michael Raig, Alfredo Lopez <br />Staff: Director of Law Michael Gareau Jr., City Engineer Pete DiFranco, Clerk of <br />Commissions Donna Rote <br />RESIDENTIAL APPEALS AleTD REQUESTS <br />CMS13-32: Rita & Sally Winson; 6666 Barton Road <br />Proposal consists of a new detached garage. The following variance is requested: <br />1. A 306 sq ft variance for an attached and detached garage in combination; code permits 750 <br />sq ft, applicant shows a total of 1,056 sq ft, Section 1135.02(c)(3). <br />Notes: 1. Existing attached garage is 480 sq ft, proposed detached garage is 572 sq ft. 2. A <br />violation was issued to remove two inoperative vehicles and to replace a dilapidated fence. <br />BZA tabled 10/7/13. <br />The oath was administered to Rita and Sally Winson, contractor John Damico and neighbors Mr. <br />and Mrs. Fulop. Rita Winson said they would lilce to construct a second garage for their <br />historical vehicles which are currently being stored in the back and yard tools which are needed <br />to maintain their property. Mr. Damico said the size of the garage is a standard size garage. A <br />concern over drainage was brought up however the garage will be drained away from the house <br />towards the rear of the property and tied into the existing line. Mr. Fulop said if the garage is <br />only 5 feet from the property line, his driveway will flood worse than it already does. It's not <br />uncommon for standing water to sit along the back of the properties. His water issues increased <br />when the applicant's addition was constructed and the topography was raised. The new garage <br />and drive will adversely impact the existing conditions on his lot. Mr. Damico said the garage <br />placement will actually catch the water and direct it to the downspouts which will be directed to <br />the rear yard or tie into the house lines. His client is not responsible for storms which occur that <br />the storm system can't handle nor should they be made to fix their neighbor's existing water <br />issues. His clients have agreed to place the garage 10 feet off the side lot line instead of 5 feet. <br />Mr. Fulop's concerns remained. Rita Winson said when the addition was added to the house the <br />elevation needed to be raised to be level with the existing structure and all engineering <br />requirements were followed, a trench along the side yard and drains along the front were <br />installed to handle water runof£ Mr. Fulop said he wanted to be assured that the new garage <br />would not increase his existing water issues. <br />Mr. DiFranco said exact property lines need to be identified. City codes require roof downspouts <br />be connected to the underground sewer system however the city would allow a soakage <br />trench/French drain which would be sized to handle any water runof£ It would eliminate any <br />additional drainage into the city storm system and/or neighboring lots: He said he would make
