Mr. Gareau said engineering and variance <br />issues are separate therefore the Board's ruling should not be conditioned upon the engineer's <br />report. Once variances are granted all applicants are required to follow the city engineer's <br />requirements. Mr. Fulop said he doesn't want anything further tied into the city system or he <br />will get flooded. If the board is going to grant the variance he wants it conditioned upon the <br />French drains being installed. Ms. Rudolph asked the engineer if there were any complaints filed <br />with the engineering department for the area and Mr. DiFranco said no. <br />Mr. Raig said he supports the request as the lot is large enough to support the garage and the <br />owners will be required to follow the engineer's requirements. The applicants were cited for <br />having the vehicles in the rear yard and denying the variance impedes their ability to address the <br />violation. Mr. Lopez said the applicant hasn't shown a hardship and he feels that the garage <br />would adversely impact the neighbors. The request is more of a want then a need. Mr. Raig said <br />the proposed garage placement is not an issue before the board, the applicant said they would <br />place the garage 10 feet from the swale. Ms. Diver said if the board can't require the applicant to <br />install French drains she wouldn't support the request. Ms. Rudolph said water runoff and the <br />garage are separate issues and can't be tied to the motion. <br />Mr. Raig moved, seconded by Mr. Lopez, to grant CMS13-32: Rita & Sally Winson of 6666 <br />Barton Road a 306 sq ft variance for an attached & detached garage in combination; code <br />permits 750 sq ft, applicant shows a total of 1,056 sq ft, Section 1135.02(c)(3) which passed <br />3-2; Ms. Diver and Mr. Lopez voted no.
