Variances are granted based upon the hardship of the site as presented by the applicant and would only change if modifications or restructuring of the site took place. Ms. Diver said she had no objections to the sign package due to the setback of the building. Members said they liked the architectural design of the marquee sign, however Mr. Lopez didn't believe they showed a hardship as to why they couldn't meet code or stay within the variances previously granted. Mr. Raig moved, seconded by Ms. Rudolph, to grant the following variances to CMS13-21: Westfield Regal Cinema of 4952 Great Northern Mall: 1. A variance for 1 additional wall sign; code permits 1 per building unit, applicant shows 4, Section 1163.28(a). Note: BZA granted a variance for 3 wall signs in 2009. 2. A 68.2 square foot variance for sign face area (sign #1); code permits 100 square feet, applicant shows 168.2 square feet, Section 1163.28(c). Note: BZA granted a variance for sign height in 2009. 3. An 8'8" height variance for wall sign (sign #3), code permits 4 feet, applicant shows 22'8", Section 1163.28(c). Note: BZA granted a variance for a 14 foot high sign in 2009. 4. A variance for a sign (sign #3) projecting over the top edge of the wall, code requires sign to be at least 12 inches below top edge of wall, applicant show sign projecting over rooftop, Section 1163.28(b). Motion passed 4-1, Mr. Lopez voted no. Mr. Swidrak reviewed the location of the proposed Rail signs and the building style branding. The theme is early 1900's industrial meat packing warehouse. Mr. Mariola said he opened the first Rail restaurant in Fairlawn in 2011 and the North Olmsted site will be the second. The signage is vital to achieve brand recognition. The sign package was scaled back to minimize the variances required. Due to the setback of the building a height variance is needed as are the canopy signs to identify they are a restaurant. Ms. Wenger said the total square footage of the wall signs are less than allowed however they exceed the four foot height limit. Due to the building setback the wall signs will be visible from the right of way however the canopy signs likely won't be. Mr. Swidrak said the wall sign letters are about 2 feet high. Ms. Rudolph said that the 5 foot wall sign is due to the sign being located within the logo. A 1 foot variance for height of wall signs (sign #5 and 96); code allows 4 feet, applicant shows 5 feet, Section 1163.28(c). 2. A variance for 2 canopy signs (signs A and B), code permits one per building entrance, applicant shows 3, Section 1163.29(a). 3. A variance for canopy signs (signs A and B) within 2 feet of other signage, code requires a minimum of 2 feet between canopy signage and all other signage, applicant shows less, Section 1163.29(.c).
